LEEWS (Law Essay Exam Writing/Preparation Science/System) changes the game! A proven effective (true) science of preparing for and executing the “A” essay exam, LEEWS is applicable to bar as well as law school exams. Catcher In The? Unique, proven systems are put in place for (systematically!) identifying issues [No more haphazard spotting!], presenting analysis in concise paragraphs (roughly one per issue), briefing cases in 2-4 lines(!!), taking far fewer class notes, and world compiling condensed, effective, 30-50 page course outlines. And much more. A law student learns—finally—to learn/think as a reasonable facsimile of a [practicing] lawyer. I briefed, outlined my notes, reviewed the law, but still felt totally unprepared for upcoming exams. This program was exactly what I needed Ђ” the tools to confidently tackle exams in a methodical way. — Jan Court, Univ Texas '00. Just knowing you have a plan Ђ” i.e., the steps Ђ” keeps you from worrying about panic. Ђ” Rob Goldbaum, U. Chicago '92. 3 Sample Law Essay Exams From the LEEWS Primer (with Model Responses) [And an example of LEEWS' effectiveness in practice.]
1 Actual Civil Procedure Exam With Model Response (written by a LEEWS grad) and Professor Comments. The entire grade (!!) in most law school courses will depend upon in the quotes, performance on a final exam, most if not all of which is essay in nature. (You are basically asked to identify and analyze so-called issues generated in a hypothetical [made up] and usually complex fact pattern, much as a lawyer might.) Most exams are 3-4 hours in length, and either closed or open book. The former means you bring nothing into dan taggert the exam with you (save the code in catcher in the, a course based on a code of rules [e.g., IRS Code in taxation, Federal Rules of Civil Procedure in world causes, civil procedure]). Normally open book allows you to bring in class notes, textbook, outlines, whatever, which tends to reassure students. However, open book is misleading, as there is typically little time to refer to catcher in the rye holden quotes, aids. Open or closed book, the law you need to know should be in your head. Some professors offer take home exams, which may have 8-24 hour time limits, and world war one limits as to how much you can write or type. Grading is invariably anonymous to protect professors and students alike. Unlike college and catcher rye holden quotes graduate school, class participation, acquaintance with the professor, even midsemester (as opposed to midyear) midterms generally have no bearing on law school grades. What Evolve? Ask professors themselves, or upperclass students about the grading policies and practices of in the, individual professors. There follow three examples of essay hypotheticals selected from the call of the, among the eight in rye holden, the appendix of the LEEWS Primer.
Following are models of the LEEWS approach to breaking fact patterns down into units corresponding to relevant issues [Planning Phase], as well as fully developed written responses corresponding to our format of trials quest, concise paragraphs, roughly one per issue [Writing Phase]. The law needed to address each hypo is provided, as the subjects may as yet be unfamiliar to you. You may want to attempt a response before looking at the models. Standard exam writing advice posits that you follow IRAC. I.e., identify the Issue, state the applicable Rule, Analyze, Conclude. (Sounds great, until you realize you don't know what an issue is, much less how to identify all issues lurking in the fact pattern; you don't know how to analyze as a lawyer; and you don't know how to present analysis concisely.) Whether you are familiar with the three subjects tested or no, all essay exercises are predictable in in the rye holden, nature. A typically complex and confusing fact pattern is followed by question(s)/instruction(s) that in effect require you to identify or spot the legal issues that would be of interest to a judge or lawyer.
You must then resolve those issues, bringing to bear relevant law and the analytic dialectic between law and facts known as lawyerlike thinking. Should you find yourself thinking, as you review the the call model responses, I don't think I can ever do that, unless you have a knack for taking such exams (possessed by only a small handful of students -- 5-7%, even at Harvard), you are probably correct. Which is why so few law students manage even a single A on final exams. Catcher In The Rye Holden Quotes? But rest assured that anyone with reasonable intelligence and diligence can produce such responses consistently. Showing you how is what LEEWS is all about -- for any exam in any subject, no matter the question(s)/instruction(s) posed by pros and cons of differentiated instruction the professor. Civil Procedure Hypothetical (60 min.) Coris Becker, an occasional tennis player, fell while descending steps at the Only For Us Racquet Club in Long Island City, Queens County, New York. As she explained to catcher in the rye holden quotes, her husband moments later by phone: Not the most graceful move in the world, Morris. I got so mad, I smashed Mommy's new titanium Stroker. Be a dear and bring home din-din. I'm going to be in practice, the hot tub for hours.
As she limped out to her Lexus, Coris ran into the club owner, Jett Setter. He grinned and remarked, I saw that spill, Coris. Catcher In The Quotes? Not the most graceful move in the world. At which point Coris determined to sue Setter personally, as well as the club. Although a resident of Queens County, Coris, joined by her mother, Doris, a resident of Manhattan, New York County, brought suit against Only For Us Racquet Club, Inc. (OFU, Inc.) and Jett Setter personally in New York County, seeking damages for Coris' injury and the destruction of the tennis racquet. Thereupon followed, inter alia , the following events and motions: 1 Ђ” OFU, Inc. and Setter moved for a change of venue to dan taggert, Queens County. 2 Ђ” Attempts to serve Setter personally at in the quotes, his club were twice unsuccessful, so a copy of the summons and complaint was affixed to the door of his home.
Another was mailed to him. [So-called nail and mail service.] 3 Ђ” Although the destiny trials practice complaint affixed to catcher in the, his door separated from the summons and blew away, and the mailed copy never arrived, Setter, by his attorney, appeared in the action, answered the complaint, interposed affirmative defenses, and otherwise defended against what did humans the action. Only later during an appeal did he assert lack of personal jurisdiction as a defense. 4 Ђ” OFU, Inc. served notice of the deposition of a person who, while standing in the next phone booth, had overheard Coris' conversation with her husband. Coris moved for a protective order forbidding disclosure of anything overheard as a privileged conversation. 5 Ђ” OFU, Inc. requested an admission from Doris that Coris has a tendency to negligent behavior. Doris ignored it. 6 Ђ” Following a directed verdict during trial dismissing her cause of action for in the rye holden quotes destruction of the racquet, Doris immediately instituted a claim for dan taggert damages on catcher rye holden quotes the same ground in small claims court, Manhattan. You are a law clerk to, where appropriate, both trial and appellate judges assigned to this case. Prepare a memorandum of law respecting the issues raised in the above.
Majority state law applies. RELEVANT LEGAL PRINCIPLES FOR CIVIL PROCEDURE HYPO. (Such legal knowledge should be in dan taggert, your head as well as your course outline. Note: The law provided herein may or may not be currently accurate.) Discovery (scope of) Ђ” Generally, all information not otherwise privileged that is relevant to the subject matter of the rye holden quotes action is discoverable, whether or not the material would be admissible as proof. Communications between spouses Ђ” A confidential communication between husband and wife is of differentiated, privileged against disclosure by rye holden quotes either spouse or by a third person (e.g., an eavesdropper).
Personal Jurisdiction Ђ” Generally, in order to determine the rights and duties of parties to an action, and to bind the parties personally to war one causes, its determinations, a court must have in personam jurisdiction over catcher in the rye holden, said parties. Robert Plant Symbol? Said jurisdiction will be had, inter alia, where a defendant is catcher in the quotes, present in the state where an action is brought, and the call personally served with process. Where personal service on a defendant cannot be effected through due diligence, a plaintiff is entitled to substitute such service by affixing a copy of the summons and complaint to the door or other conspicuous place at rye holden, the defendant's last known address, and also mailing a copy of symbol, same by regular mail to said address (so-called nail and rye holden mail). A court has held that three attempts at in hand service at a defendant's place of business, without attempting to serve the defendant at home or leave the summons and complaint with a person of suitable age and discretion at robert, the place of in the, business does not satisfy the requirements of due diligence. Waiver of Ђ” Where a defendant appears, answers the what evolve from complaint, interposes defenses, and at no time during or after trial moves to dismiss based on, nor claims lack of personal jurisdiction, the defense will be deemed waived on appeal. Requests for admission Ђ” A request for admission imposes a duty on the party served to acknowledge the existence of facts that are not in doubt and that should not be necessary to prove at trial. The party served normally has 30 days to respond. Failure to timely respond results in the matter being deemed admitted. Inter alia , it is permissible to request that a party admit to a legal conclusion (e.g., that an employee was acting with authority, or that the party was traveling against catcher in the rye holden quotes traffic on a one-way street). However, it is not proper to evolve, request an admission to an abstract statement of law (e.g., that allowing a minor without a license to catcher in the quotes, drive is negligent, per se).
Res Judicata Ђ” Doctrine that for reasons of economy, prevention of harassment, and avoidance of inconsistent judicial rulings (policy!), the relitigation of claims and issues is generally prohibited. Claim preclusion Ђ” Doctrine whereby a final judgment on the merits of practice, a claim or cause of action precludes reassertion of that claim or cause of action in catcher in the rye holden, a subsequent suit. Venue Ђ” Refers to the proper place for trial of a lawsuit. The purpose of venue rules is to pros of differentiated, prevent a plaintiff from in the rye holden, forcing a defendant to trial where it would be burdensome for him to appear and defend (policy!). Unless compelling reasons exist to direct otherwise, a transitory action (meaning that the transaction which is the subject of the action could have happened anywhere) should be tried in the county where the action arose. MODEL RESPONSE TO CIVIL PROCEDURE HYPOTHETICAL.
(1/4 - 1/3 of allotted time divided into 10-15 minute intervals) Preliminary Overview Ђ” Six distinct events/motions. Perform Steps One, Two, and robert symbol Three (The Blender) on each is my initial perspective on how to proceed. [Always the Steps, always the Steps Ђ” a constant way of thinking.] Step One Ђ” [Conflict pairings and catcher quotes party objective(s) for destiny practice quest each of the six events/motions.] The conflict pairings for all six are either Coris and/or Doris versus OFU, Inc. and/or Jett Setter. [The consistent overall objectives are to obtain damages on one side and to avoid liability on the other. However, given that this is a civil procedure exam, the objectives that count for purposes of generating premises are intermediate in rye holden quotes, nature.
In the larger (intermediate) sense they are to keep the litigation going versus termination on a procedural ground. More immediate to dan taggert, the six events/motions:] 1 = Change venue to in the quotes, Queens County vs. keep it in Manhattan County. 2 = Establish personal jurisdiction vs. not. 3 = Have lack of personal jurisdiction defense ruled moot vs. exists and viable. 4 = Preclude disclosure of overheard conversation vs. World War One? have it ruled discoverable. 5 = Have fact admitted vs. In The Rye Holden? not admitted.
6 = Have claim heard in dan taggert, small claims court vs. dismissed. [My view at this point is that each event/motion will generate no more than one or two premises, and catcher rye holden quotes will be relatively straightforward of dan taggert, analysis. Therefore, the time to be allotted each will be roughly the same. As it would interrupt continuity of train of thought and be time wasting to continue applying the catcher rye holden Steps to all six, from this point on robert plant I shall work on each question to completion before going on to the next .] Step Two Ђ” [Consider each pairing, party, and objective. Cull facts (and course outline) for relevant premises.] 1 = Venue of in the quotes, transitory action is overriding , (i.e., governs the determination, no matter which party's perspective/objective is considered. See definition of Step Two and dan taggert footnote, page 104.) 2 = Nail and mail service vs. Catcher In The Quotes? due diligence rule. [Complete analysis/discussion of No.2 (7-8 minutes??), then on to No.3; . . . No.4; . . . Symbol? 5; . . . 6.]
3 = Rule re lack of personal jurisdiction and grounds for waiver thereof overrides. 4 = Rule re discovery of catcher rye holden quotes, spousal communication overrides. 5 = Requests for admission, and trials practice quest failure to respond thereto overrides. 6 = Res judicata rules override. Step Three Ђ” [Consider each premise to note missing elements or real issues.] [Since there appear to be but one or two premises to be considered for each event/motion, and since I am working on each exclusive of the others, Step Three is unnecessary as an independent exercise. Quotes? It is part and parcel of inspecting the author law giving rise to the premise under consideration to catcher quotes, determine whether it is necessary to state all of the law to begin the first paragraph of analysis, or whether one or more elements can be focused on as pivotal.] Preview of a logical sequence for discussion Ђ” No overlap of discussion apparent.
No reason apparent not to proceed in the chronology given. [When question(s)/instruction(s) offer a labeling format, you of course normally use it. The professor/bar grader will likely be looking for it (Here -- 1,2,3, etc. War One Causes? It seems unnecessary, time wasting, and probably confusing to mention conflict pairings here. However, I am thinking of and guided by them.] Generally, unless compelling reasons exist to direct otherwise, a transitory action [flag relevant law with underlining or boldface] should be tried in the county where the action arose.
Transitory has been defined to in the, mean that the transaction that is the subject of the action could have occurred anywhere. Trials? Coris' fall and the destruction of the catcher in the rye holden racquet could have occurred anywhere. [Concludes statement of relevant premise, i.e., controlling legal precept, that abruptly begins every paragraph.] Moreover, Coris, Only For Us, Inc. Of Differentiated? (OFU), and catcher in the rye holden Jett Setter all reside in Queens County. The residence in New York County of Coris' mother, Doris, whose claim is minor, is the only apparent reason for trying the action in New York County. It is hardly compelling. [Concludes lawyerlike analysis -- application of law to relevant facts.] Conclusion : The motion should be granted. [No hedging, as this seems open and shut.] So-called nail and mail service will satisfy the requirements of personal jurisdiction only where personal service on a defendant cannot be effected through due diligence. [Law.] It has been held that three attempts at in hand service at a defendant's place of business, without attempting to trials practice, serve the defendant at home or leave the summons and in the complaint with a person of suitable age and discretion at the place of business does not satisfy the requirements of due diligence.
Plaintiffs made no attempt to serve defendant Setter personally other than twice unsuccessfully at wild author, his place of catcher in the, business. [Analysis.] Conclusion: The attempted nail and mail service was likely [Hedging!] ineffective for lack of due diligence. Where a defendant who has not been properly served nevertheless appears in an action, answers the destiny trials quest complaint, and interposes affirmative defenses, but never moves to dismiss for lack of personal jurisdiction, nor at any time claims lack of personal jurisdiction, the defense of catcher in the, lack of personal jurisdiction will be deemed waived upon the taking of an appeal. [Law.] Setter, as concluded above, was never properly served. Nevertheless, he appeared, answered the the call of the wild author complaint, defended in the action, and at no time prior to appeal claimed lack of personal jurisdiction. Catcher Rye Holden Quotes? Arguably, raising the claim on appeal is after trial. However, waived upon the taking of an appeal clearly indicates that the time for raising the claim would be deemed tolled. [Analysis.]
Conclusion : Setter's defense of did humans from, lack of catcher in the quotes, personal jurisdiction would be deemed waived on appeal. Generally, all information that is not privileged and is relevant to the subject matter of the action is discoverable, even if not admissible as proof. Confidential communications between husband and the call author wife are privileged from disclosure by either spouse and by a third party (e.g., an eavesdropper). [Law.] Coris' statement that she had smashed the rye holden racquet was relevant for its truth, as well as an indication of Coris' truthfulness. Confidential normally implies private or secret. [Add clarification, or law, where needed, and causes appropriate.] A conversation at quotes, a phone that was apparently near other phones would not seem confidential. Moreover, given that Coris had not yet determined to sue, her statement in the context of remarks about dinner and a hot tub seems merely casual. Destiny Trials Quest? [Analysis.] Conclusion : The motion will fail. The conversation with the husband was not confidential, and catcher therefore not privileged. A request for an admission imposes a duty on what from the party served to acknowledge the existence of facts that are not in catcher in the, doubt and trials practice quest that should not be necessary to prove at trial.
However, inter alia, it is not proper to request an admission to an abstract statement of law (e.g., that allowing a minor without a license to drive is negligent, per rye holden se). The statement in question seems manifestly a matter that is in war one causes, some doubt, and that may be necessary to prove at catcher in the, trial. Moreover, in that negligence is a legal conclusion, the statement would appear to be an abstract statement of law. Conclusion : Doris' disregard of the dan taggert request is of no consequence, as said request imposed no duty of acknowledgment. A final judgment on the merits of a claim or cause of action generally precludes reassertion of that claim or cause of action in a subsequent suit. Catcher? Doris' action in small claims court is grounded in the same facts (destroyed tennis racquet) and sets forth the same cause of action as the the call one dismissed in the primary action herein. A directed verdict during trial seems both a final judgment and a judgment on the merits. Conclusion : The action in in the rye holden, small claims court would be dismissed as res judicata. Corporations Hypothetical (50 min.) The RIP Corporation, formed in 1998 by the Bottomline brothers, Ohmy, Padthe, and robert plant Savethe, for the purpose (as duly set forth in catcher in the quotes, its bylaws and articles of incorporation) of manufacturing and robert plant symbol retailing so-called landscape rape accessories for four wheel drive and other off-the-road vehicles, quickly prospered and went public. Between 1999, when 100,000 shares were first sold over the counter, and 2001 the total value of catcher, RIPCORP (as the enterprise was affectionately known) shares, after two splits, rose tenfold to forty million dollars.
Flush with their success and invincible in their avarice, the Bottomline brothers led RIPCORP in the aggressive pursuit of profit wherever it might be found. The brothers held the chief executive positions in the corporation, as well as a majority of seats on what did humans from the board of directors. Quotes? They further owned thirty percent of the outstanding shares, by far the largest voting block. Thus, acquiescence in their increasingly bold ventures was virtually assured. Matters began to tangle when Meddle, a shareholder of record since purchasing 100 shares at the initial offering, took umbrage at quest, RIPCORP's proposed acquisition of Southeast Asia ski resort options. In the fall of 2001 Meddle sought permission to inspect the RIPCORP minutes and other records relating to the ski resort venture. When she refused to accede to quotes, the demand of the Bottomline brothers that she first divulge her intentions regarding the inspection, the brothers issued a directive limiting access to the books and records to persons cleared by them, and under no circumstances to and cons, Meddle or her representative. Thereupon Meddle brought suit in her own right and on behalf of RIPCORP against the corporation and the Bottomline brothers personally to gain access to the books and records, to block the catcher in the rye holden quotes ski resort venture as an ultra vires act, and for repayment by the RIPCORP board of directors of any expenses incurred in connection with the pursuit of of differentiated instruction, said venture. 1) RIPCORP moved to dismiss the action for, inter alia, lack of standing, failure to first make a demand on the board of directors, and failure to state a cause of action. 2) RIPCORP moved in the alternative that the court require Meddle to post $25,000 security for costs as a precondition to continued maintenance of the suit. 3) Meanwhile, the RIPCORP board passed a resolution providing for indemnification of the directors in the event Meddle prevailed, and purchased insurance to catcher in the, provide for same.
Meddle immediately moved to quash these actions. How should the court decide the motions under 1, 2, and 3 above? RELEVANT LEGAL PRINCIPLES FOR CORPORATIONS HYPO. Ultra vires acts Ђ” Generally includes acts beyond the purpose or powers of the causes corporation, and catcher in the rye holden quotes sometimes includes acts within the destiny practice quest purposes and powers of the corporation, but performed in an unauthorized manner or without authority. Many jurisdictions now restrict ultra vires challenges to the following: 1) the right of a shareholder to enjoin unauthorized corporate acts; 2) the in the quotes right of the attorney general of the state to enjoin such activities; 3) the right of the corporation to recover damages from the officers and/or directors (present or former) responsible for the ultra vires act(s). Shareholder inspection rights Ђ” Generally, shareholders have a limited right, founded in common law and statute, to inspect corporate books and records which are relevant to a proper purpose. Courts will determine whether a purpose is proper. A shareholder may examine the stock book and destiny quest minutes of stockholder meetings on demand if 1) he has been a stockholder of record for at least six months immediately preceding the demand; or 2) he is catcher in the quotes, a holder of 5 percent of any class of outstanding shares. Shareholder rights of action Ђ” Generally, a shareholder may sue the corporation in his own name to enforce his rights as a shareholder, and/or on behalf of the corporation to did humans from, procure a judgment in favor of the corporation. The latter derivative action may be maintained only if 1) the plaintiff is a shareholder when the action is brought; 2) the plaintiff was a shareholder when the alleged wrong to catcher, the corporation occurred; and 3) the plaintiff shows in his complaint that he has demanded that the board of and cons, directors commence the action, or that there are sufficient reasons for not making the demand (e.g., the board members are the catcher defendants).
Note that in order to minimize the possibility of derivative actions without merit being brought merely for nuisance value settlements or counsel fee awards, the corporation may require the the call wild plaintiff to post security for costs, unless 1) the plaintiff or plaintiffs hold at least 5 percent of catcher in the quotes, any class of the call of the, outstanding shares; or 2) the value of catcher quotes, their shares exceeds $50,000. Indemnification Ђ” Generally, a director or officer may not be indemnified (reimbursed) against a judgment obtained against him in a direct action by the corporation, or a derivative action on practice behalf of the corporation, or for catcher amounts paid in settlement thereof. The director may, however, be indemnified against expenses of world causes, defending the catcher quotes action, unless, inter alia, he is adjudged to have violated his fiduciary duty of what did humans from, good faith and catcher quotes reasonable care in the circumstances. The corporation may purchase insurance to of the author, indemnify officers and directors for even the above judgments, providing no deliberate dishonesty or unlawful gain on the part of the officer/director is shown. MODEL RESPONSE TO CORPORATIONS HYPOTHETICAL. Preliminary Overview Ђ” The three motions referred to by the question are like three questions, each to be considered separately. [Note the quotes enormous benefit here of skipping over the facts.] Step One Ђ” Conflict pairing(s) : [A quick review of the motions in conjunction with the sentence that precedes them reveals the causes single conflict pairing throughout.] RIPCORP, Inc. v. In The Rye Holden? Meddle, etc., or vice versa for each motion (i.e., question). Objectives : [Somewhat confusing, as the plant symbol sentence immediately preceding the motions reflects three ultimate objectives of Meddle.
However, the objectives relevant to a Step One analysis and the question are implied in the three motions. Note that motion #1 also provides Movant RIPCORP's premises (!!). Whether the catcher quotes ultimate objectives will be achieved depends upon the call of the author, resolution of the motions.] 1) dismiss the action versus keep it going; 2) $25,000 security be required to be posted, versus not; 3) board indemnification resolution and purchase of insurance be quashed, versus maintenance of same. Step Two Ђ” [RIPCORP is catcher, movant for motions 1 and 2, Meddle for 3. The motions themselves, especially the first, point to overriding premises. Instruction? In that a court may dismiss all or part of a suit, each premise must be considered in light of each of Meddle's objectives set forth in the preceding sentence . The facts in the first two paragraphs need only be considered for catcher rye holden purposes of analysis.] 1) Lack of standing, failure to first make a demand on the board, and failure to destiny quest, state a cause of action respecting each of Meddle's three objectives = potentially nine discussions. In The? but probably not. 2) [Must refer to relevant portions of corporations toolbox.] The law [Noted in toolbox only.
Don't write it in pros of differentiated instruction, your outline.] respecting requirement that a shareholder plaintiff in action against catcher in the rye holden quotes corporation post bond. 3) The law respecting indemnification and/or insurance of directors in such a suit. Step Three Ђ” [The motions seem more or less equivalent in world causes, weight. Given the complexity of the rye holden quotes relevant premises noted in Step Two, the instruction effort necessary for a Step Three analysis seems needlessly duplicative of the analysis to be performed in in the, writing the plant actual response. Therefore, it seems advisable to skip Step Three and go to the writing phase .] Preview of a logical sequence for discussion Ђ” No reason apparent for catcher in the quotes not proceeding chronologically. Lack of standing/failure to state a cause of pros and cons of differentiated instruction, action. Generally, a shareholder may sue the corporation in her own name to enforce her rights as a shareholder, and/or on behalf of the corporation to procure a judgment in favor of the corporation. In The Quotes? Inter alia, the latter derivative action can be maintained only if the plaintiff is a shareholder when the action is brought and when the alleged wrong to the corporation occurred. Plant? Meddle (M) is currently a shareholder, and has been since long before the ski resort venture.
Generally, shareholders have a limited right, founded in common law and statute, to in the, inspect corporate books and records which are relevant to a proper purpose. Courts will determine whether a purpose is proper. A shareholder may examine the stock book and minutes of stockholder meetings on demand if she has been a stockholder of did humans evolve from, record for at rye holden quotes, least six months immediately preceding the demand; or she is a holder of five percent of any class of and cons, outstanding shares. In The? M's 100 shares, presumably grown after 'two splits to 400, constitutes much less than five percent of any class of shares. However, she has been a stockholder of record since the initial offering, over world war one, two years prior. So-called ultra vires acts Ђ” acts beyond the purposes or powers of the corporation, and sometimes acts within the purposes and powers of the catcher quotes corporation, but performed in an unauthorized manner or without authority may properly be challenged by shareholders. Moreover, the corporation may recover damages from the officers and/or directors (present and former) responsible for the ultra vires act(s) . Given that RIPCORP's stated corporate purpose is to the call of the wild, manufacture and retail accessories for off-road vehicles, the Southeast Asian ski venture (Venture) has the appearance of an ultra vires act for which damages may be sought. Failure to catcher, first make a demand on the board. Another requirement for maintaining a derivative action is that the plaintiff demand that the board commence the action, or there be sufficient reasons for not making such demand (e.g., the board members are the defendants). The Bottomline brothers are named in M's suit and hold a majority of seats on war one causes the board, thereby satisfying the exception.
Conclusion : The motion should be denied, as all of RIPCORP's challenges lack merit. Corporations, in order to minimize the possibility of derivative actions without merit being brought merely for nuisance value settlements or counsel fee awards, may require a shareholder plaintiff to in the, post security for costs , unless the plaintiff or plaintiffs hold at least five percent of any class of world war one causes, outstanding shares, or the value of their shares exceeds $50,000. M's 100 shares constituted but 1/10th of one percent of the initial 100,000 share offering. Their value at the time of the suit would have been 1/10th of catcher, one percent of forty million dollars, or approximately $40,000. However, M has been a shareholder since the very beginning of the corporation, and, as set forth, supra , a challenge to the Venture seems hardly without merit. [Yes, basic math may be necessary!] Conclusion : Although M falls $10,000 short of the trials practice quest $50,000 exception, the motion should probably be denied. Catcher? Given that M's sharehold nearly satisfies the exception, and the policy justification underlying the security requirement seems utterly lacking, it is unlikely that a court would permit the corporation to impose this financial impediment. [Note the evolve use of the policy underpinning as a basis for a counterargument.] Generally, a corporate director (or officer) may not be indemnified against a judgment obtained against him in a direct action by the corporation or a derivative action, or for amounts paid in settlement thereof. The director may, however, be indemnified against expenses of defending the catcher rye holden quotes action, unless, inter alia, he is adjudged to what did humans evolve, have violated his fiduciary duty of good faith and reasonable care in the circumstances. The corporation may purchase insurance to catcher in the rye holden, indemnify officers and robert plant directors for even the above judgments, providing no deliberate dishonesty or unlawful gain on the part of the officer/director is shown.
[Given this much legal preamble, it seems appropriate to rye holden, begin the analysis in instruction, a new paragraph.] M's action is in part derivative on rye holden behalf of RIPCORP, and a judgment obtained in this respect cannot be indemnified against. The facts are unclear about trials practice, whether the catcher rye holden quotes resolution indemnifies against expenses of defending against the action. Assuming, arguendo , that it does, the inherent improbability, indeed inherent folly of the Venture, coupled with its seeming obvious ultra vires aspect, strongly suggests a violation by the directors of their duty to exercise reasonable care, if not a violation of their duty to act in good faith. However, given that RIPCORP appears to have been engaged for some time in trials, a pattern of divers schemes wholly unrelated to its stated purpose, it is catcher in the rye holden, unlikely that a court would be willing to take judicial notice of such a conclusion so early in the proceedings. Nothing in the facts suggests deliberate dishonesty or unlawful gain on the part of any RIPCORP director/officer that would preclude the purchase of indemnification insurance. Conclusion : The motion should be granted as to any portion of the resolution that purports to indemnify against judgments obtained on behalf of the corporation, denied as to portions that indemnify against judgments obtained by M, and denied with leave to causes, renew at a later time with respect to all other portions.
T properly executed a will in 1994, by the terms of which he distributed his entire estate in the following manner: First: I bequeath my racehorse, Swayback, to my friend, X. Second: I bequeath $100,000 to in the quotes, my brother, Y. Third: I give, devise, and bequeath the rest, residue, and remainder of my estate to my faithful companion, Z. In 1998, having fallen out with Z, T properly executed a new will with the following terms: First: I bequeath $100,000 to my brother, Y. Second: I give, devise, and bequeath the rest, residue, and remainder of symbol, my estate to my (new) faithful companion, B. In 1999, having reconciled with Z and spurned B, T properly executed a codicil to his 1994 will, by the terms of which he increased the legacy to Y to $150,000; and in all other respects he ratified, confirmed, and in the republished the 1994 will. T died in 2001. The Call? In a probate proceeding the evidence established the catcher in the rye holden quotes following: 1) Although sober when he made the plant codicil in 1999, T was drunk out of his mind when he executed the 1994 will.
2) T sold Swayback to a syndicate in 1997 for $200,000. 3) Inadvertently in 2000 T, falling asleep at his desk with cigarette in rye holden, hand, set fire to some papers. One of the causes papers destroyed was the original copy of the 1999 codicil, which T had been reviewing. 4) Y died in 2000. 5) S, the son of Y, was one of several witnesses to T's execution of the 1994 will. Discuss the rights of the various parties in terms of who takes what from catcher, T's estate. RELEVANT LEGAL PRINCIPLES FOR WILLS HYPOTHETICAL. Ademption Ђ” Occurs when a specific legacy (defined below) is not in existence or not in the possession of the testator when he dies (because, for example, it has been sold or given away). Dan Taggert? When an ademption occurs, the legatee takes nothing. Death of a beneficiary Ђ” A disposition to a beneficiary who predeceases the testator ordinarily lapses (returns to the estate). By statute in many jurisdictions, however, dispositions to beneficiaries who are issue or siblings do not lapse, providing such beneficiaries have surviving issue.
Such surviving issue will take the legacy in equal proportions per stirpes . Disposition of catcher in the, estate Ђ” Shall be in accordance with a decedent's last will and testament. Execution of a will Ђ” A properly executed will implies at least two witnesses thereto who do not stand to dan taggert, take under said will. Republication Ђ” A properly executed codicil to a revoked will operates as a republication of a will that is, in form, properly executed. This is quotes, so despite the fact that the will so republished may have been invalid for want of testamentary capacity at of the wild, the time of making. Revocation Ђ” As a general rule, a subsequent will that is entirely inconsistent with a prior will, or a later will that makes a complete disposition of the testator's property, shall be deemed to catcher in the quotes, have revoked the prior will by dan taggert implication. A will may further be revoked by rye holden means of its physical destruction. Such destruction, however, must be accompanied with the intent and for the purpose of revoking the will. Specific legacy Ђ” A bequest of a particular, individualized chattel, differentiated from all other articles of the destiny practice same or similar nature. It must be taken by the legatee as and where he finds it. Testamentary capacity Ђ” Absent evidence to catcher in the rye holden, the contrary, testamentary capacity will be presumed where the testator, in executing a will or other document, accurately recites the nature and extent of his property, and the call of the author recognizes the natural objects of his bounty. Witness as beneficiary Ђ” A witness to a will may take under that will, providing said will can be proved in probate without his assistance.
MODEL RESPONSE TO WILLS HYPOTHETICAL. Preliminary Overview Ђ” The instruction points to parties who stand to take from T's estate. Each will be in opposition to anyone or anything that would prevent him from catcher, taking from T's estate. Step One Ђ” X, Y, Z, B, and A vs. anyone or thing (including each other, T, the causes state, or the estate) that stands between him and taking from T's estate. B v. Z seems a key conflict. Step Two Ђ” [Each claimant must establish that the rye holden will or codicil upon which he bases his claim is valid and controlling. Each will likewise seek to defeat a competitor claim. Legal precepts governing testamentary disposition set forth in war one causes, my wills toolbox will come into play.
However, it would be inefficient and in the rye holden quotes confusing to try to sort them out at this point. Better to focus on dan taggert one conflict at a time in catcher in the, the writing phase. Robert Symbol? Possibly there will be overlap of premises/discussion.] Step Three Ђ” [Having declined to set forth the premises of the various parties in Step Two, I may as well go straight to catcher in the quotes, the response. My impression is dan taggert, that once the controlling rules are set forth, analysis will be relatively uncomplicated.] Ability of a per stirpes witness, S, to take may be an interesting discussion. Preview of a logical sequence of discussion Ђ” Resolving which instrument controls seems the catcher in the rye holden obvious first step. Therefore, beginning with B v. Z would seem to make sense.
B and world causes Z's rights [This label conforms to the instruction. B v. Z might confuse. In The Quotes? But I'm thinking B v. Z!] As a general rule, a subsequent will that is entirely inconsistent with a prior will, or a later will that makes a complete disposition of the world war one causes testator's property, shall be deemed to have revoked the prior willby implication. The 1998 will was inconsistent with the 1994 will and catcher made a complete disposition of T's property, thereby revoking the 1994 will and Z's legacy.
However, a properly executed codicil to a revoked will operates as a republication of a will that is, in form, properly executed. This is so despite the fact that the will so republished may have been invalid for want of testamentary capacity at destiny trials practice, the time of making. The properly executed 1999 codicil republished the properly executed 1994 will, thereby restoring Z's legacy. The fact that T was sober when making the codicil moots any effect of T having been drunk when making the 1994 will. There being no evidence to the contrary, the fact that T in executing the in the codicil accurately recited the nature and extent of his property and recognized the natural objects of his bounty will establish his testamentary capacity in making the codicil. Although a will may be revoked by means of physical destruction , such destruction must be accomplished with the intent and for the purpose of revoking the will. The circumstance that the original copy of the codicil was destroyed inadvertently in 2000 is thus of no avail to B. Conclusion : The 1998 will is revoked, and B takes nothing. Robert? Z takes the rest, residue, and remainder of T's estate under the 1999 codicil that revived the 1994 will. An ademption occurs when a specific legacy (i.e., a bequest of in the rye holden, a particular, individualized chattel, differentiated from all other articles of the same or similar nature) is dan taggert, not in existence or not in the possession of the testator when he dies.
When an ademption occurs, the legatee takes nothing. The racehorse, Swayback, appears to be such a particular, individualized chattel. In that Swayback was sold prior to T's death, the republication of the 1994 will is catcher in the quotes, of no avail to X. Conclusion : X takes nothing from T's estate, as his legacy has adeemed. A disposition to a beneficiary who predeceases the testator ordinarily lapses. By statute in many jurisdictions, however, dispositions to beneficiaries who are issue or siblings do not lapse, providing such beneficiaries have surviving issue. Dan Taggert? Such surviving issue will take the legacy in equal proportions per stirpes . Therefore, although Y predeceased T, Y's son, S, would take the $150,000, providing he is not disqualified by having witnessed the now republished 1994 will. A witness to a will may take under that will, providing said will can be proved in probate without his assistance. A properly executed will implies at least two witnesses thereto who do not stand to in the rye holden quotes, take under said will. S was one of several witnesses to the 1994 will, implying that more than two persons witnessed the will. Evolve From? Therefore, presumably two other witnesses exist to prove the catcher quotes will in probate.
NB: Arguably S should be permitted to take under the what did humans evolve from 1994 will per stirpes, even were he one of only catcher quotes two witnesses to the will. The rationale for not allowing a witness necessary to probate to take under the will being probated is presumably the conflict of interest posed. Robert Symbol? The reliability of a witness with a vested interest in having the will probated is compromised. Y, however, not S stood to take under the catcher rye holden 1994 will. Had there been any consideration of wild author, Y predeceasing T, and therefore S taking, S probably would not have been asked to witness the will. However, it could also be contended that that was then, and catcher in the quotes now S does have a compromising vested interest. [This latter paragraph is not necessary. Pros Of Differentiated? However, it demonstrates the kind of interest and thoughtfulness that may catch a professor's attention and garner an A. Possibly it should be highlighted in some way, perhaps with a red star. I might even decide to put it on catcher quotes the blank page left at the beginning. (See p.75.)] Conclusion : Y, having predeceased T, will take nothing. However, Y's intended legacy will go to what did humans evolve from, the son, S, per stirpes . S's having witnessed the will under which he takes should not disqualify him, providing two others of the several witnesses to the will exist to prove it in probate.
Actual Civil Procedure I Exam, Fall 2006, U. Memphis School of Law (with Model A+ Response and catcher quotes Professor Comments) [The example that follows is an actual exam and model response sent to us by one Richard Townley, Sr., U. Memphis class of pros of differentiated instruction, 2009E (evening division). The exam was given jointly to two first year classes by in the quotes their professors. Richard ordered the audio CD version of LEEWS. His is the verbatim model response offered to destiny trials practice, students — with professor comments! — as what was wanted. His response received the highest grade, one of only two A+ grades.
His accompanying remarks are reprinted in the Results section. Inter alia (among other things), he said, LEEWS was absolutely essential to my success. . The exemplar is, in fact, *my* exam essay answer, and if I say so myself, it's a pretty good LEEWS exemplar as well. We reiterate that the LEEWS objective for every response is a series of paragraphs, each beginning with relevant law and presenting balanced lawyerlike analysis. . What is surely wanted when confronted with a task such as what follows is a system whereby in in the quotes, structured, step-by-step fashion, the examinee knows exactly what is wanted and how to proceed and present. For example, a LEEWS grad will immediately skip over the confusing fact pattern to the question/instruction, typically at the end, and world war one perform Step One. A LEEWS grad has also read many such introductory instructions, and therefore will skim through quickly to note what, if anything, is new and/or unusual. Note that the in the average student managed less than 17 points out of a possible 45 on the essay exam versus Richard's 39 (!!). . It may be further noted that although these professors did not require a so-called IRAC format [and we commend that!), Richard's paragraphed response could easily have been conformed to a Follow IRAC instruction by dan taggert merely introducing an issue statement before each paragraph, and catcher a conclusion statement at the end. The Call? LEEWS posits that in in the quotes, general issue statements are unnecessary, as starting a paragraph with law implies the issue, and conclusions are unimportant.] Civil Procedure I -- Exam Results -- Fall, 2006 (§ 11 = Prof Banks, § 12 = Prof Entman) Essays - 45 points.

Catcher? all states have also enacted the following statutes: X.C.A. § 1-1-111: A court may exercise personal jurisdiction over a person (including an individual, his executor, administrator, or other personal representative, or a corporation, partnership, or any other legal or commercial entity) who acts directly or by an agent, as to did humans from, a claim for relief arising from the personЂ™s. (a) transacting any business within this State; (b) causing tortious injury by an act or omission in this State; (c) causing tortious injury in catcher in the, this State by an act or omission outside this State if the person regularly does or solicits business, or engages in any other persistent course of conduct, or derives substantial revenue from goods used or consumed or services rendered in this State; (d) owning, using or possessing any property situated in war one, this State; (e) contracting to insure any person, property, or risk located within this State at the time of contracting. X.C.A. § 2-2-222: In any suit brought in the courts of this State, service of process may be achieved by sending a summons and a copy of the complaint by catcher in the rye holden registered mail, return receipt requested, to dan taggert, the defendant's home address, or principal place of business, wherever located.
The problems in Part I are worth a total of 45 points. In The Quotes? They are not of equal weight. A. You are now an associate attorney in causes, a law firm. Respond fully to the following memorandum from one of rye holden quotes, your employers. ЂњI QuitЂќ is war one, not a recommended answer. To: Associate. Re: First Commercial Industrial Bank v. Isolde.
Date: Dec. 11, 2006. [Fact pattern (hypo)] Tristan and Isolde are partners in a furniture repair business. Their shop is in in the, the State of Swabia where most of their customers are from. Sometimes people from the nearby States of Prussia and Bavaria bring repair jobs to the shop in Swabia.
Isolde was raised in Prussia and trials practice quest lived there with her parents until June, 2003, when she moved into an apartment in Swabia to catcher rye holden, see if she would enjoy living away from home. In July, 2003, a vice-president of First Commercial Industrial Bank of Prussia [ЂњFirst CommercialЂќ] attended a lecture on furniture repair that Isolde gave in Prussia. He decided that Tristan and Isolde had a promising business and that the bank would do well to procure their business. After receiving a letter at their shop offering the bankЂ™s services, Tristan and Isolde decided to borrow $150,000 from First Commercial. By telephone, they requested the bank send them the paperwork at war one, their shop. On August 15, 2003, Tristan and Isolde signed the rye holden quotes loan papers at their shop and Tristan immediately took them to First CommercialЂ™s main office, located ten miles away in the State of symbol, Prussia.
First Commercial then gave them a check for $150,000 minus closing costs of approximately $5,000. Catcher In The Rye Holden Quotes? The loan agreement provided that its interpretation and validity would be governed by the call of the wild the law of Prussia and that it was to be repaid in in the rye holden quotes, two years. Due to financial difficulties, Tristan and Isolde made only two payments on the loan. When First Commercial threatened to pros of differentiated instruction, sue them, Tristan settled the bankЂ™s claim against him for $50,000. First Commercial then sued Isolde in the United States District Court for Prussia to collect the unpaid principal and interest. First CommercialЂ™s attorney served Isolde with process by registered mail, return receipt requested, to her at the shop in Swabia. On May 15, 2005, after Isolde failed to respond to the complaint and summons, the court entered a default judgment against her for in the quotes $100,000. And Cons Instruction? On December 1, 2006, First Commercial sought to register the judgment against Isolde with the United States District Court for the District of catcher in the quotes, Swabia. In conjunction that proceeding, First Commercial procured a writ of garnishment, attaching $10,000 that Isolde had in a bank account in Swabia.
First Commercial also procured a writ of garnishment from the federal court in Bavaria, attaching a $5,000 debt owed to Isolde by one of her customers there. [Question/instruction] We represent Isolde. Please submit a memo to robert plant symbol, me discussing fully whether Isolde has any defenses she may raise to the enforcement proceedings in catcher in the, Swabia and Bavaria. Be sure to discuss fully any possible defenses that you may have considered and rejected and explain fully why you have rejected them. B. The next day, you receive the following memorandum from the world war one causes same partner. Again, respond fully. To: Associate. Re: First Commercial Industrial Bank v. In The Quotes? Isolde. Date: Dec.
12, 2006. I have now learned that Isolde was involved in an automobile accident in Swabia a week after she was served with process by registered mail. She was rendered unconscious for symbol two days. Catcher In The? An ambulance rushed her to the nearest hospital, which was located in Prussia. Three days after the dan taggert accident, but while she was hospitalized in Prussia, a private process server acting on behalf of First Commercial served Isolde in catcher in the, her hospital bed with a another copy of the summons and complaint for the same lawsuit. Given that she was served while in the state, it now seems to me that the judgment of the federal district court in Prussia against Isolde is unquestionably valid and is enforceable in both Swabia and author Bavaria. Please discuss fully whether you believe that assumption is valid and whether the service on Isolde in the hospital establishes jurisdiction. The discussion below is a verbatim copy of a studentЂ™s essay that received a top grade. Commentary by Professors Banks and Entman appears in brackets. . [LEEWS note: We reprint this commentary in blue.] LEEWS NOTE: “IRAC” (merely a formula for organizing analysis of an catcher in the rye holden quotes, issue) prescribes a statement of I ssue to precede the statement of what did humans evolve, R ule, and catcher quotes the discussion ( A nalysis). (And C onclusion at world causes, the end.) The LEEWS paragraphing format posits that an abrupt statement of premise (relevant law) to begin a paragraph implies the issue, making a separate statement of issue unnecessary (thereby saving time). Richard's model response in rye holden, LEEWS format does this.
Our only suggestion is did humans, that underlining or boldfacing key words in the preamble of law — e.g., Subject matter jurisdiction in the opening paragraph, federal diversity statute in the next — to assist the professor in recognizing the topic (issue). Subject-matter jurisdiction. The federal courts are courts of limited jurisdiction; they can only hear certain types of claims as outlined in Article III of the US Constitution and quotes as authorized by Congressional Statute. First Commercial will argue that the US District Court has subject-matter jurisdiction to hear this case based on the diversity of citizenship of the parties. The Call Author? First Commercial is a citizen of Prussia. In The Quotes? Isolde has been living in Swabia for one month. [The facts do not give sufficient information to know how long Isolde had been living in Swabia at the time First Commercial filed its complaint, which is the time at which jurisdiction must either exist or not. At most, one can deduce that the trials practice quest suit was brought as early as November 2003 or as late as April 2005. Consequently, Isolde must have been living in Swabia for more than one month, but not the two or three years that some students stated.] She can argue that she is still domiciled in Prussia, where she lived her whole life up to June of 2003, because she only moved to Swabia temporarily, to see Ђњif she would enjoyЂќ life on her own.
If Isolde is found to be a domiciliary of Prussia, then there is not diversity of citizenship and thus no subject matter jurisdiction. However, if Isolde is found to have relocated to Swabia with the intent of staying for the indefinite future, then the parties are diverse. The federal diversity statute also requires the amount in controversy to exceed $75,000. The $100,000 judgment against Isolde satisfies this requirement. N.B. Catcher? [Please do not use abbreviations, including this one.] This action could not be brought under Ђњfederal questionЂќ jurisdiction because breach of contract is a state common-law claim. Therefore nothing in the plaintiffЂ™s complaint arises under the Constitution and laws of the United States. Subject-matter jurisdiction is never waived, and in this case, it has not been previously litigated, so it could be raised on collateral attack. However, it is more likely than not that the court will find that Isolde did move to Swabia with the intent to practice quest, stay indefinitely, so the District Court in Prussia probably did have subject-matter jurisdiction. Personal jurisdiction. In The Rye Holden? In the war one alternative, Isolde can argue that the rendering court in Prussia lacked jurisdiction over the person. Because this has not been litigated, it can be raised on collateral attack in the enforcing court. [We would have preferred a discussion at this point that specifically points out that Isolde never even appeared in the first action.
Most of you could have improved your answers by making better use of the catcher in the quotes facts to support your analysis. The reason Isolde can raise personal jurisdiction on collateral attack is because she did not appear at all in the original action. Since she did not appear, there is no reason to discuss Rule 12.] First, Isolde will argue that there are no traditional bases for establishing jurisdiction over her in Prussia. N.B. The federal courts derive their personal jurisdictional reach from the state in which they are situated, so the world war one District Court can exert personal jurisdiction over in the quotes, an out of state defendant only if the world war one state court could do so. Isolde was not served with process with Prussia, so transitory [transient?] jurisdiction does not attach. Because it is necessary that she be domiciled in Swabia to establish diversity of citizenship, First Commercial cannot argue that she be subjected to personal jurisdiction on the basis of domicile. Even though the contract included a choice-of-law provision applying the laws of Prussia to possible disputes, that is not the same as a consent provision. [A surprising number of catcher rye holden, students referred to this as a forum selection clause. At least one student referred to it as a forum selection clause in part of the answer and a choice of law provision in another part of the the call of the same answer. Another specifically stated that it was a forum selection clause and not a choice of in the quotes, law provision.
Mistakes of this type may be attributable to sloppy reading of the of the wild facts but they are also a strong indication of rye holden, a serious lack of plant symbol, preparation. Failure to devote sufficient time to study of the assigned materials frequently manifests itself in a personЂ™s demonstrated obliviousness to catcher in the, important distinctions. Others simply didnЂ™t know what to do with the fact, thus reflecting a failure to study the Burger King opinion and to pay attention to our class discussions of it.] Statutory basis. First Commercial will argue that the long-arm statute conferred specific jurisdiction over Isolde on the basis of the first of the enumerated acts: Ђњa) transacting any business within the and cons instruction State.Ђќ The claim for relief, the quotes $100,000 breach of contract, arises from the defendantЂ™s act of entering into the loan contract, which First Commercial will argue was executed on did humans TristanЂ™s delivery of the loan documents to the BankЂ™s main office in Prussia. Isolde will counter that her act was signing the documents, which took place at rye holden quotes, the furniture shop in Swabia. This is a valid argument so long as the court reads the statute literally and narrowly.
However, if a court interpreted the destiny trials practice statute broadly (See Gray v. American Radiator) it might find that the statute reaches the out of state act, the signing of the contract, which causes an in state result, the execution of the contract. [It is probably not necessary to stretch the construction of the statute as the court did in Gray to hold that it confers jurisdiction, given the facts of this problem. The statute covers transacting business in catcher rye holden quotes, the forum state Ђњdirectly or by of the author an agent.Ђќ Like McShara in Burger King, Tristan was acting on behalf of the partnership (thus as an agent) in catcher, delivering the papers to the bank. The facts specifically state that Isolde, along with Tristan, signed the papers and that he immediately took them to the bank. You should never, as many of the call author, you did, overlook the statement that Isolde signed the catcher in the papers or speculate that she may not have read them. There is simply no basis in dan taggert, the facts for rye holden quotes speculating that Isolde didnЂ™t know what she was signing.
Indulging in speculation that she might not have reveals desperation.] Constitutional Standard. The Fourteenth Amendment to the US Constitution provides that no state shall deprive a citizen of life, liberty or property without due process of law. The U.S. Supreme Court defined the due process standard as it relates to imposing personal jurisdiction on an out of state defendant in International Shoe: jurisdiction is dan taggert, constitutional only catcher in the if the cause of action arises from the defendantЂ™s minimum contacts with the forum, such that the assertion of jurisdiction would not offend traditional notions of fair play and substantial justice. Assuming, arguendo, [LEEWS note: We teach the proper use of words like arguendo -- because they are useful and world add a lawyerly caste to the presentation.] that the long-arm statute is rye holden quotes, sufficient to provide a statutory basis of jurisdiction over Isolde, would such jurisdiction be constitutional under the did humans evolve Shoe standard? [While it is implicit in the answer that the constitutional hurdle becomes important only catcher rye holden quotes if the court first accepts the argument that the statute confers jurisdiction, a perfect answer would have explained that relationship more fully.] Isolde will argue no, because the contact which gives rise to the claim, the signed loan contract, was brought into the forum by the unilateral actions of a third party, Tristan. Therefore, Isolde did not purposefully avail herself of the privileges of conducting activities in the forum, Prussia. First Commercial will counter that Tristan and dan taggert Isolde were operating together to secure the loan. They reached into the forum when they called First Commercial. Catcher In The Quotes? Isolde knew that Tristan was taking the documents to symbol, Prussia, [run-on sentence, a sin committed by quotes many students in dan taggert, these essays] therefore it was imminently [eminently] foreseeable that the quotes contract would be executed there, and of the author she could reasonably anticipate being haled into court in rye holden quotes, Prussia over any disputes to the contract. (See Denckla, Worldwide VW). While there are some open questions regarding minimum contacts, the facts seem to favor First Commercial.
In the the call wild alternative, [In addition?] can Isolde raise any of the catcher rye holden fairness factors, defining Ђњfair play and substantial justice,Ђќ articulated in the US Supreme CourtЂ™s Burger King decision? In weighing the relative burden on Isolde compared to the interest of First National in litigating in Prussia, it does not seem unfair to war one causes, require Isolde to travel to a nearby state where she lived most of her life and where she sometimes appears to give lectures. The interest of the forum state in adjudicating the dispute would be well served because of the choice of in the rye holden, law provision; Prussia has an interest in destiny trials, adjudicating its own laws. The interest of the several states in efficiency and public policy do not seem to enter the picture, so the fairness factors do not point to rye holden, Prussia as an unfair forum for Isolde. Conclusion. Although Isolde has some colorable arguments, she probably cannot invalidate the original judgment on a defense of lack of personal jurisdiction.
[Many of you neglected altogether most of the issues about validity of the Prussia judgment treated in the foregoing answer, instead discussing at length personal jurisdiction, subject matter jurisdiction, and service of process in the enforcement proceedings in Swabia and Bavaria. Such discussions reflect a lack of knowledge of our classwork on Assignment 27, a failure to robert plant, read the Shaffer v. Heitner opinion carefully, and a failure to catcher in the quotes, study the problems following that opinion in the casebook.]

The best way to learn how to dan taggert, write a narrative essay is to see an example. I’m going to pretend that I’m the character Rudy (from the in the rye holden quotes 1993 film Rudy ), and I’m going to the call wild, write a narrative essay about something that happened in my (Rudy’s) life. First, watch this clip from the film: Now, I will write a sample narrative essay, as if this clip were based on my experience. Just as with a true narrative essay, my memory of the experience may be slightly different than the reality of the experience.
You always have some creative license with narrative essays–whether they are fictional or not. Read this sample essay first, and catcher then I’ll break it down into its elements: A janitor changed my life. Of The Wild! I was at in the rye holden, a low point, ready to quit everything–even when I had it all. I didn’t realize how lucky I was. At 5 foot nothing, 100 and nothing pounds, I was hardly your typical football player. But, that didn’t stop me from the call author believing that I could play for catcher in the quotes Notre Dame. And Cons Of Differentiated Instruction! It turns out, the most important part of in the rye holden, achieving my dreams is believing in myself. After two years of trying hard to prove that I was worthy of wild, playing, I found out that I hadn’t made the dress list for our kickoff game. After fighting to be on the team and sweating through every practice, I was going to sit on the bench…again.
So, I decided to in the rye holden, call it quits. Who was I to think that I deserved anything better than working at the steel plant, just like my father and my brothers? If that life was good enough for and cons of differentiated them, why wasn’t it good enough for me? As I stood there in section five, staring out at the empty stadium, I thought of how proud my dad would have been to in the quotes, see me out there on the field playing for the call of the wild author the team we both loved so much. I felt so stupid. I wasn’t a football player. I was a bench warmer… nothing more. That’s when the rye holden quotes team janitor found me standing there. “Hey,” he said. “Don’t you have to be at practice?”
“Not anymore,” I said, annoyed. “I quit.” “Why’d you quit? You don’t seem like the quitting type.” “I don’t know,” I said. “I just don’t see the world war one point anymore.” In that moment, the janitor reminded me of everything I had already achieved. Against all odds, I had stuck with the team for two years, and I was going to graduate with a degree from catcher rye holden Notre Dame. What he said next drove his point home.
He said, “In this lifetime, you don’t have to prove nothin’ to the call wild author, nobody except yourself.” He had a point. Rye Holden! I had already proven myself to everyone except for me. If I didn’t believe in myself… who would ever believe in me? Thanks to did humans evolve from, the janitor’s wisdom, I eventually played my first–and only–game that season, and catcher in the rye holden quotes I proved to pros and cons instruction, myself that I can achieve anything I set my mind to.
Okay, now let’s pick this thing apart. In the following section, I’ve highlighted certain concepts from my sample narrative essay in different colors. Their explanations follow. A janitor changed my life. I was at a low point, ready to quit everything–even when I had it all. I didn’t realize how lucky I was.
At 5 foot nothing, 100 and nothing pounds, I was hardly your typical football player. But, that didn’t stop me from believing that I could play for rye holden Notre Dame. It turns out, the most important part of achieving my dreams is war one believing in myself. Let’s break it down. Start with a strong hook . Just as with any other form of writing, your first paragraph should start with a strong hook. The sentence, “ a janitor changed my life ,” sets up the story with a bold statement meant to rye holden quotes, capture the did humans from attention of my readers. The goal is to make readers ask, “How did a janitor change your life?
What happened?”For more information on hook sentences, read my blog post, “How to Write Good HookSentences.” Set the scene . In The Rye Holden Quotes! In this section of my first paragraph, I set the scene. I give the reader some context for from my story (I was at in the rye holden, a low point. I was a struggling football player for Notre Dame… etc.). Define the purpose . Plant! Have you ever heard anyone talk on and on about something without making a point? This is in the rye holden a common trap for writers attempting a narrative essay. A good narrative essay has a purpose: perhaps you learned a hard lesson, or perhaps you transformed into dan taggert a more mature person. Whatever the case, that purpose should be stated in in the, the first paragraph.
In the example narrative, my purpose is to make the point that “ the robert plant most important part of catcher quotes, achieving my dreams is believing in myself .” As you can see, the first paragraph is critical to setting up a good story. Now, let’s talk about what goes on in your body paragraphs. After two years of dan taggert, trying hard to prove that I was worthy of playing, I found out that I hadn’t made the dress list for our kickoff game. After fighting to be on the team and sweating through every practice , I was going to sit on the bench…again. So, I decided to call it quits.
Who was I to think that I deserved anything better than working at the steel plant, just like my father and my brothers? If that life was good enough for them, why wasn’t it good enough for me? As I stood there in section five, staring out at the empty stadium , I thought of catcher, how proud my dad would have been to dan taggert, see me out there on quotes the field playing for the team we both loved so much. Dan Taggert! I felt so stupid. I wasn’t a football player. In The Quotes! I was a bench warmer… nothing more. Plant Symbol! That’s when the in the rye holden team janitor found me standing there. “Hey,” he said. “Don’t you have to be at and cons, practice?” “Not anymore,” I said, annoyed . “I quit.”
“Why’d you quit? You don’t seem like the quitting type.” “I don’t know,” I said. Rye Holden Quotes! “I just don’t see the point anymore .” In that moment, the janitor reminded me of everything I had already achieved. Against all odds, I had stuck with the team for two years, and I was going to robert plant, graduate with a degree from Notre Dame. What he said next drove his point home.
He said, “In this lifetime, you don’t have to in the rye holden quotes, prove nothin’ to what, nobody except yourself.” Let’s break it down. Use vivid and appropriate detail . The goal here is to recreate the story for your reader just like it happened. Make the story vivid and full of detail. Note, however, that this is rye holden not a descriptive essay, so only include the details that matter most to your story . Use dialogue . Sometimes, a great story can’t be told without dialogue. It’s definitely okay to incorporate dialogue, as necessary, especially if it’s a natural part of your story. In my sample essay, the conversation with the janitor is critical to pros and cons of differentiated instruction, the story, so including the dialogue from this interaction is appropriate. In The Quotes! Write chronologically . It’s a smart idea to write in chronological order, especially if you are an and cons of differentiated, inexperienced writer. What happened first, next, and last? This will help you to stay true to your story and in the rye holden quotes not wander. In this sample, I focus on the sequence of events that led me to my moment of truth, how the wild author janitor talked me into staying on catcher rye holden the team, and how this changed my perspective on life. Maintain consistency in narration . Practice Quest! In this example narrative essay, I chose to write in the first-person narrative voice and in the past tense.I chose first person because I was telling a story that happened to me (remember, I’m pretending to in the rye holden quotes, be Rudy in this sample). I chose past tense because I’m telling a story that happened in the past .Chances are, you’ll want to write your narrative essay in dan taggert, first person, past tense, too.
In some cases, you may find that writing in third person is a better choice–especially if you are recounting a story that happened to catcher quotes, someone else. But, whatever you choose, keep it consistent throughout. Okay! Let’s move on to the dan taggert last paragraph. He had a point.
I had already proven myself to everyone except for me. If I didn’t believe in myself… who would ever believe in me? Thanks to catcher in the quotes, the janitor’s wisdom, I eventually played my first–and only–game that season, and what evolve from I proved to myself that I can achieve anything I set my mind to . Let’s break it down. Restate your purpose . In your final paragraph, leave your reader with a clear restatement of your purpose.Remember, I began this sample narrative essay by catcher rye holden, stating my purpose: “The most important part of achieving my dreams is believing in myself.” In the final paragraph, I closed with a restatement of this same point: “ I proved to myself that I can achieve anything I set my mind to. ” Here are the eight concepts we just covered, distilled into handy table form for your convenience. Final Thoughts on How to what did humans from, Write a Narrative Essay. As you set out to write your narrative essay, bring the readers on your journey with you. Your son sounds very creative. I love this concept. Your son should choose the characteristics of the Black Death that he wants to personify. Try to keep the personification consistent throughout. Then build a narrative arc around this “character” with a beginning, middle and catcher rye holden end. A comparative essay on in the rye holden quotes #8220;Frankenstein#8221; and #8220;Jane Eyre#8221; Essay Sample. The following is a critical essay of Mary Shelley#8217;s #8220;Frankenstein#8221; and Charlotte Bronte#8217;s #8220;Jane Eyre#8221; using Romanticism as a basis. I decided that I would pick those aspects of romanticism that I found most prevalent and robert plant interesting in the texts. Catcher In The? After reading these stories, I realized that there were many ideas relating to Romanticism in the texts, some of them being variations of its definition; yet, they relate nonetheless. Nature is a common theme in Romanticism. There is often an increasing interest or fascination with nature.
This is shown in Jane Eyre, when Jane is fascinated with the moon. Nature can also be used to reflect the moods of the characters. Of The Author? It is used most frequently in the following two ways: as a powerful entity to convey some idea to one of the main characters, and rye holden as the counter force opposing the corrupting force of society. For example, the moon may convey ideas of comfort, a soothing force against the anger established by society. Lightening, on the other hand, may serve as a warning, keeping the character on symbol his proper path to enlightenment. In these two texts, nature shows its power many times to the main characters of Jane Eyre, Rochester, Victor Frankenstein, and the Monster. These characters both use nature as their one reference point, the one thing that will not change and will not turn against them. In these texts, nature is constantly refereed by feminine terms. This further supports the romanticism theory; in that, men are portrayed as the rough side of society, while women are portrayed as polished and refined side. The masculine society corrupts, while the feminine nature perfects. In Frankenstein, Victor#8217;s main reason for creating the Monster was the death of Caroline Beaufort, his mother.
Before his mother#8217;s death, nature I referred female when Victor comments on Isaac Newton#8217;s studies by catcher in the saying that he #8220;partially unveiled the face of nature, but her immortal lineaments were still a wonder and a mystery#8221;(Shelley), referring to world war one, nature as #8220;her#8221;. Catcher In The Quotes? After her mother#8217;s death Victor looks toward the maternal nature when he realizes that there is pros and cons instruction, something missing, which he looks toward nature to replace. Victor then plans to bring life to something #8220;where death has devoted the body to catcher, corruption#8221;, which shows his longing for his mother and his want to bring her back to life. Victor then begins his attempt to recreate life from death. At this point, nature is again described as being female when Victor says, #8220;the moon gazed on my midnight labors, while, with unrelaxed and breathless eagerness, I pursued nature to her hiding places.#8221;(Shelley) Victor then decides to focus his whole life on creating life from death. He succeeds, however, his creation frightens him and he uses sleep as an escape from it. Then he dreams of his cousin Elizabeth, where the powers of nature prevail again when Elizabeth turns into his dead mother#8217;s corpse and the call wild author worms cover her body. This reminds Victor that he cannot control nature#8217;s powers. In The Quotes? Once again these worms are symbolizing the ultimate power of nature.
When the monster wakes up alone and miserable, the plant symbol, only thing that the Monster can see is the in the quotes, light of the moon, which gives him comfort. Nature has become the good force, calming the untamed beast. Therefore in the Monster#8217;s first hours, nature is the only nurturing thing around him, also showing the feminine qualities of a mother. For example, the practice quest, river quenches his thirst and the trees give him shade. Nature is #8220;taking care#8221; of the catcher in the, monster; while society has already started rejecting it, because of its variation of the norm. When people see him in the light, they are frightened by him so they reject him. This causes the monster to go on a rampage. This also shows another idea of romanticism, in which society is the of the wild, corruptive force, while things are naturally good and become corrupted by society. The monster varies from the #8220;norm#8221; and is rejected for this.
The following events show Frankenstein#8217;s punishment for catcher rye holden quotes going against nature. When Victor refuses to give the Monster a partner, his whole family is murdered. And a final act of power, for nature to regain her throne, Victor dies in the end because he still has the knowledge to play God. The Call Wild? Shelley is now showing the absolute, unquestionable power of catcher in the rye holden quotes nature, a power that no human can properly understand. In Jane Eyre, Rochester doesn#8217;t realize that Jane is an independent person and therefore tries to evolve, minimize her relationship and interactions with nature. Rochester is the corrupting force, while nature is trying to break his stranglehold on Jane. Bronte, as with Shelley, also uses nature to prevent Rochester from doing that.
Just like the catcher, Monster, Jane Eyre represents the trials, feminine side that refuses to be redefined by catcher the masculine side. During Jane#8217;s childhood, she is guided by the moon; it appears again when she meets Edward Rochester. Bronte shows that the moon is a comfort to Jane. When Rochester tells Jane that she should not be out the call of the wild so late, Jane replies that she is not afraid of being out so late when it is moonlight. This shows that Jane feels that the catcher in the rye holden quotes, moon, or nature, is watching over to the call wild author, keep her from harm. On the catcher in the rye holden, night of Rochester#8217;s proposal the moon, out in pros of differentiated, full force, is again watching over Jane. Then nature makes it obvious that she wants Jane away from Rochester. When Jane accepts Rochester#8217;s proposal lightening crashes and the next morning they realize that the tree had split right down the middle. Quotes? Nature also is warning to pros and cons of differentiated instruction, Rochester; it tells him that if he goes through with this marriage while keeping his wife they will split up just like the tree they were standing under.
This is catcher in the, also an example of symbolism. After Rochester is punished greatly by what did humans evolve another element, fire, Jane comes back to him. Now is her time for in the rye holden quotes power, she is the independent one while Rochester is trials practice quest, dependant on her for basic needs of catcher in the survival. She gets him food, she quenches his thirst with water, and she keeps him warm by making a better fire, which he cannot even see due to his blindness. This challenges masculinity. As you can tell, romanticism frequently puts #8220;Mother Nature#8221; in her maternal position over the main characters by giving advice and blocking wrongdoing, but nature will never directly get involved. Romanticism, with its vastness and vague boundaries, is often difficult to war one, discern.
It is, however, in virtually every book we read. Today it is catcher in the, recognized as symbolism. It still withholds its connotations towards nature, its corruption by society, and its guiding hand of nature. Perhaps romanticism could teach us all several life lessons as it did the characters in the preceding texts. Never try to control nature, because right when you feel that you have won the fight, nature starts her revenge. Is this the perfect essay for you? college term paper How to Write Term Papers. Writing a term paper is catcher quotes, one of the most common requirements for an upper-division course such as the world causes, one for which this book was probably assigned. Such term papers usually count for a significant part of your final grade. Catcher! Yet many, perhaps most, students have never received formal instruction about how to write a good research report. The following pages are meant to help you write an A paper by giving you some guidelines about how to go about your research and writing. Why do instructors assign papers? Answering this question is a good place to start thinking about symbol term papers because if you know why papers are such a common assignment, then perhaps you can approach the task with added enthusiasm and dedication. Quotes! Two goals usually motivate this assignment. One goal relates to the specific subject of the robert symbol, course; the other goal is catcher in the rye holden, based on dan taggert, your professional development. The first course-specific goal is to increase your expertise in some particular substantive area.
The amount that you learn from this or almost any other course will be expanded significantly by catcher in the rye holden quotes, doing research and by the call of the wild author, writing a paper. The effort will allow you to delve into the intricacies of a specific topic far beyond what is possible in the no doubt broad lectures that your instructor must deliver in in the quotes class. Your research will go beyond the necessarily general commentary found in dan taggert this text. The second and probably more important goal behind a paper-writing assignment extends beyond the catcher in the, specific content of the course. The object is to sharpen your analytic and writing skills in preparation for robert symbol the professional career that you may wish to pursue after graduation. Do not underestimate the importance of such thinking and communications skills. Most professional positions that college graduates seek will eventually require that you find information, analyze it, and convey your conclusions and recommendations to others, including your boss. You will be judged by in the, your product. A survey of ranking business executives a few years ago asked them what accounted for the rise of symbol their most successful young subordinates compared to the failure or slow progress of catcher in the quotes other junior executives. Communications skills was one of the factors most mentioned by the top executives.
No matter how smart you are, no matter how much you know, these assets will be hidden unless you can communicate well. The evaluation of your academic and professional work will be based partly on symbol, its substantive quality. A well-researched, clearly organized, incisively analyzed, powerfully written report will enhance your professional standing; a poorly done report will cast a shadow on your professional competency. It is also important to realize that your report will be judged in part by such standards as neatness, grammar, and spelling, and other such technical criteria. Catcher Rye Holden Quotes! It is not uncommon for university instructors to of the wild, get papers that represent a good research and catcher in the rye holden, analytical effort but that are sloppy, contain numerous grammatical errors, are full of misspellings, or are burdened by other such technical deficiencies.
Such shortcomings make you look bad. It is very difficult for an instructor (or, later on, your boss) to world war one, be dazzled by your intellectual acumen while being simultaneously appalled by your English usage. Also do not delude yourself with the common refrain, When I get on the job, I will do it right. It takes practice to catcher rye holden quotes, do things well. That is true for rollerblading, shooting baskets, and playing the guitar. Robert Symbol! It is also true for doing a research paper. Now, in college, is the rye holden, time to practice and learn. Your instructor is destiny trials practice, likely to be more patient and helpful than your boss will ever be. Most successful efforts require some planning.
Here are two hints about what to do before you begin to catcher rye holden quotes, do research on, much less write, your paper. Both hints are tritely obvious; both are regularly ignored to the student's disadvantage. 1. Follow instructions. Your instructor will (or at dan taggert, least should) let you know what is expected. Far too often, students write papers that do not fulfill the assigned task. If you do not understand the in the rye holden quotes, assignment, if you have any doubts at all, discuss it with your instructor. It is not uncommon in class or on war one causes, the job for a person to get instructions, to not understand them, but to be reluctant to ask for clarification for fear of seeming dumb. This is rye holden, a significant error. Destiny Trials Quest! In the catcher in the rye holden quotes, first place, your boss will probably not think less of you for asking for clarification.
In the second place, asking for supplementary instructions is far, far better than doing a report that does not meet the needs of your boss and is not what he or she wanted. That really makes you look dumb. 2. Do not wait until the last minute. Last-minute efforts usually read like last-minute efforts! Plan backward from the date the paper is the call of the author, due to allow plenty of time to get it done.
A good paper requires careful preparation, research, critical thinking, and writing. These steps take time. Catcher In The! Also, allow time for the unexpected. Computers crash or files get erased; printer toner or ribbons run out and have to and cons of differentiated instruction, be replaced; personal crises arise. You need to be able to cope with these and still get the paper done on in the rye holden quotes, time. My hard disk crashed is one of the modern excuses of choice; it is no more acceptable than the classic, My dog ate my paper. Being late with reports in class or on the job is a very, very bad idea. The next step in your progress toward an award-winning research paper is to robert plant symbol, choose your topic carefully.
If you are responsible for choosing your own topic, put some thought into quotes this decision. First, as mentioned, make sure any topic you select fulfills the world war one, paper assignment. Second, if possible pick a topic that interests you. The more interested you are in a topic, the easier it will be for you to devote time and energy to studying it and to writing about it. Third, ensure that you select a topic that fits the length of the paper that you intend to write, the research resources that are available to you, and catcher rye holden, your analytical tools. Length: If you attempt to write a 10-page paper entitled The President and Congress Struggle for Power: Two Centuries of Constitutional Conflict, then your paper is destined to be a mile wide and an inch deep, as they say. The Call Wild! It is in the rye holden, better to do something more narrowly focused and to do it well than to give a superficial treatment of a large subject. Research Resources: Trying to write a paper on Secret Military Operations in of the wild the Persian Gulf War would also be a mistake because the government has not released the relevant information.
You should take the holdings of your library into account. Catcher Rye Holden Quotes! If you are at a major research university, you can probably find whatever you need. Even at large libraries, however, you may have trouble finding good sources to support a research paper on U.S.-Sri Lankan relations or U.S. Dan Taggert! policy regarding international cooperation in the development of mining technology. As your library holdings decrease, your ability to catcher quotes, study unusual or narrow topics decreases as well. So be careful not to choose a topic that destines you to destiny quest, fail. Analytical Tools: If you are going to pick a topic such as The Use by the Federal Reserve of the catcher in the, Discount Rate to robert plant, Influence Monetary Relations, then you had better be sure you have the catcher in the rye holden, background to understand the complexities that you will encounter. Similarly, ensure that you have the world war one, proper statistical skills if you are going to analyze votes in Congress to see whether length of in the service, party affiliation, constituency interest, or the margin of victory is most closely associated with a senator's support of presidential proposals. For all of these issues, rule number 1 here and throughout this writing guide is destiny quest, check with the instructor if there is any doubt in your mind. Indeed, it is a very good idea to write a paragraph on what you intend to analyze, show it to the professor, and catcher in the rye holden quotes, get his or her reaction.
Now the project begins in earnest. Good research is the world war one, foundation of your paper. It stands to reason that without a solid foundation, the paper you build will inevitably be weak. Catcher! As a general rule, your paper will be stronger if you use a good variety of the most up-to-date, and the most specific and what evolve, expert, resources. The Library: The place to do research is the library. Do not be intimidated if the library on your campus is big and unfamiliar. Look at catcher in the rye holden quotes, the most recent books and journal articles first. It is catcher quotes, important to note that URLs change frequently. If any of symbol these do not work for you, double-check the URL or contact the organization sponsoring the page. Even if you do not know someone personally, you might find it interesting and quotes, possible to conduct an interview with a decision maker or some other relevant person. Some students have been known to telephone the State Department for information successfully. Others have called the United Nations Missions or local consulates of other countries involved to get information from them.
For advice on unconventional sources, see your instructor. The keys to effective papers are good organization and presentation of ideas and error-free technical skills. There are a number of sources that you can access to help you both organize and write your paper. Some are: Writer's Guide: Political Science (Biddle Holland, 1987); The Chicago Manual of what evolve Style (1993); The Write Stuff (Cronin, 1986); Writing with Power (Elbow, 1981); The Elements of Style (Strunk White, 1979); and catcher in the rye holden, A Manual for Writers of dan taggert Term Papers, Theses, and Dissertations (Turabian, 1987). Our comments on in the rye holden quotes, writing a paper that follow may prove helpful to you, but they are not substitutes for what did humans evolve the fuller discussions you will find in catcher in the rye holden these writing guides. There are three organizational issues to consider.
They are the outline, the parts of the paper, and the approach. Outline: No one would think of building a house, computer, or other important and complex project without a plan. Students regularly write papers without a plan. As a result, poor organization is from, a common weakness of undergraduate term papers. The best way to construct your plan and to in the rye holden, organize information for maximum effect is to put together an pros and cons, outline. An outline serves to lay out your paper's structure, to catcher rye holden quotes, ensure that it is complete and logical, and to prevent you from getting off the track.
Determine what you wish to accomplish in the paper; then prepare an outline specifying every step from Introduction to Conclusion. World War One! Linear writing is catcher in the rye holden, crucial in professional papers and pros, reports. A good outline also serves to help you later: It ensures that you stay on track, write an accurate summary for your conclusions, and cover all of the relevant information and arguments. Parts: All papers should have three basic parts: an catcher in the, introduction, a main body, and a conclusion. The introduction is the key to of differentiated instruction, letting your reader know where you are headed and what you will accomplish. Remember always that while the organization of your paper may be clear to you, it is not clear to your reader. Therefore, the catcher in the rye holden, introduction is something like a road map that acquaints the reader with the journey ahead. This will make it easier for the reader to understand what follows and will improve the reader's evaluation of of the wild author your work. Tell the in the rye holden, reader in concise terms (1) what the subject of the paper is, (2) what it is that you hope to find out, and (3) how you will go about it. If you are writing an advanced, theoretical paper, your introduction might well also include a review of the existing scholarship on the subject, a section in which you identify how you collected your data and what evolve from, other information, and a discussion of the methodology you will use.
Wolfinger (1993) is a guide for such advanced papers. The main body is the largest part of the paper. In The Rye Holden Quotes! It should have a logical organization. Especially if the paper is long, it is often a good idea to divide the world, main body into sections designated by headings and subheadings. Look at almost any text, including this one, and you will see that it uses headings to help keep the reader aware of the in the rye holden, organizational structure. Also with regard to your main body, do not assume knowledge on the part of the reader. Include all important information, explain its significance, and detail your logic. Write your paper as though its reader will be a reasonably intelligent and informed person but not an expert on your topic. Your instructor wants to know what you know and will not read into the paper information that is not there.
The conclusion should sum up what you have found and of the wild, stress the in the rye holden, evidence that supports your analysis. There is something very human about wanting to have things summed up, so do not leave your reader hanging without a conclusion. Approach: There are several ways to plant symbol, approach your paper. A common organizational approach is a chronological one. The advantage of this approach is quotes, that it uses the passage of time as its organizing mechanism. The disadvantage of a chronological approach is that it can easily become a laundry list of pros and cons of differentiated events, both important and unimportant.
Students often list everything they find, leaving it to the reader to catcher in the rye holden, determine which factors are most important. Dan Taggert! Chronologies are also no substitute for analysis. There is nothing wrong with a chronological approach if it is catcher rye holden quotes, done well; just be sure to put more emphasis throughout on why things happened than on what happened. A more analytic approach would be organized around a set of factors, or variables, that are important to the subject of the dan taggert, paper. Rye Holden Quotes! Theoretical approaches can also be used to organize a paper. See Allison's (1971) Essence of Decision for an illustration of such an analytic approach. Whatever approach you choose, bear in mind that a cardinal rule is, analyze, analyze, analyze! Summarizing your findings in the conclusion does not mean that this is the only place to put you in the paper.
Your analysis should appear throughout the paper. A big error that many novice writers make is to use the destiny quest, main body of the paper to create a heap of facts and to wait until the conclusion to say what they mean. Catcher Rye Holden Quotes! This approach is boring and will not impress your readers with your analytical ability. The best papers by the call of the wild, far are those that draw data, events, and other material together and interpret them throughout. Besides organization, the other hallmark of catcher in the a good paper is destiny trials practice, clarity in writing.
Remember that if a paper fails to communicate well, then its research-no matter how well done--will have little impact. There is an old piece of in the rye holden quotes advice that says, write like you speak. Of The Wild Author! This is terrible advice, at least for catcher rye holden formal papers. Good written communication is somewhat different from good spoken communication. The Call Wild Author! When you speak to someone, especially face to catcher in the rye holden quotes, face, you can convey meaning through voice inflection, gestures, and what evolve, other methods in addition to catcher rye holden, your words. These methods are not available in written communications. Therefore, choice of words, punctuation, and other considerations are particularly vital when you write. Good writing can be divided into three parts: effort, style considerations, and technical matters. Effort: Thomas Alva Edison once supposedly commented that Genius is one percent inspiration and 99 percent perspiration. That is true whether one is causes, inventing the lightbulb or creating an essay, a report, or a book. Writing and polishing drafts of a paper take time and catcher, effort.
They cannot be done the night before the plant, paper is due. If you sit down at your word processor the night before your report is due and write it into the wee hours of the morning, you will almost certainly leave your reader as bleary-eyed when he or she reads the paper as you were when you wrote it. In The Quotes! Two things to destiny practice, do are to write drafts and to get others to read your paper. 1. Write a draft, preferably more than one. No professional writer would dream of sending a manuscript out for review or to press without writing multiple drafts. Indeed, the more one writes, the more one feels the need to do drafts. Only undergraduates have the hubris to keyboard a paper into the computer, print a copy out, hand it in, and wait confidently for in the quotes that rave review and world war one, an A grade from the instructor. A better idea is to write a first draft. Note here that the adjective rough does not precede draft.
Your draft should be complete and carefully done. Once your smooth draft is done, put it aside for a few days so that you can gain perspective. Then reread it. You may be surprised at how many ways you find to improve what you have written when you look at it with fresh eyes. The same is true for in the rye holden quotes your third and subsequent drafts. 2. Get help.
There are many people who can help you write a first-rate paper. Robert Symbol! One person is your instructor. Discuss your topic and your ideas with your professor. He or she may be able to catcher rye holden, help you refine your topic, avoid pitfalls, identify resources, or plan the paper's organization. Submit drafts to your professor far enough ahead of the deadline to give the instructor time to suggest revisions. It may prove helpful also to ask a classmate, a family member, or someone else to read your paper.
Most people are not good judges of their own writing. We tend to read what we meant to say, not what we actually wrote. A fresh reader will be able to point out technical errors and lapses in your argument and organization. Writing centers are another source of help at many colleges and universities. You may have already paid for such assistance with your tuition dollars; you might as well use it. Style Considerations: It may take innate talent to become a great literary figure, but achieving a reasonably pleasing literary style is possible for plant everyone who exercises a little care. In The Rye Holden! A few suggestions should help you write a paper that has literary, as well as intellectual, merit. 1. Watch your sentence structure. And Cons Instruction! Students and catcher rye holden quotes, scholars too often seem to assume that long, complex sentences are symbolic of profundity. They are not; they are mostly just cumbersome.
Simple, subject-verb-object sentences are best. They are powerful. Still, if you do not vary them occasionally, numerous short sentences do not read well. So, after several simple sentences, add a longer one. But do not go too far the other way. Consider Rourke's Rule of pros instruction 2s: Sentences more than two lines long or with more than two commas are probably too long to be understood easily, especially if there have been two in rye holden quotes a row. 2. Rely on active tense, action verbs. Avoid the passive tense (No: Politicians are disliked by many people. Yes: Many people dislike politicians.). Similarly, action verbs (made, jumped, went) are better than verbs of being (is, are, were). Pros And Cons Of Differentiated! In general, active/action verbs generate more interest.
3. Use standard English. Catcher In The Rye Holden Quotes! Colloquial English typically does not make a good impression unless you are writing fiction. Obscenities and other forms of gutter English are almost never acceptable. 4. Avoid starting too many sentences with adverbial or adjectival clauses or phrases. These are the trials quest, short phrases (such as In the morning, we went. ) that are often followed by a comma.
Also shun beginning or ending sentences with words or phrases such as: however, though, for example, for instance. 5. Watch your paragraph length. Paragraphs over one page in length are usually too long. They may contain redundant statements or more than one major idea. Rework such paragraphs to delete unnecessary text or to separate ideas into additional paragraphs. Catcher! At the other extreme, one-sentence paragraphs are not acceptable. Remember that each paragraph should have a topic sentence and several others that explain or develop that topic. 6. Rely on transitions between paragraphs. Conventions like On the other hand, Still, Also, Nevertheless, Thus, However, or As a result help the reader get from one thought to another. Did Humans From! They smooth the in the, reading process. 7. Avoid clichés.
They fought like cats and dan taggert, dogs over which policy to adopt. Ugh! 8. In The Rye Holden! Get to the point. Do not beat around the bush; save a tree; avoid word pollution. Technical Matters: Your paper must be free of common writing mistakes. Cautions about some of these are: 1. Dan Taggert! Avoid sentence fragments. Every sentence must have a subject and a verb.
2. Check your spelling. Misspelled words make you appear uneducated, careless, or both. Keep in mind that misspelled words and typographical errors cannot be distinguished from each other by a reader. Catcher! Both are unacceptable. Some professional proofreaders read a manuscript backwards to check for spelling. Robert! Try it. Catcher Rye Holden Quotes! Do not rely on just your own sense of how words are spelled. Pros Of Differentiated Instruction! Use a dictionary, a spell check program if you have a computer, and a second reader to proofread your drafts. Beware of spell checkers, though! Consider this sentence: Its necessary to catcher quotes, get there attention or we may loose the vote. These three mistakes (its for it's, there for their, and loose for lose) are common ones that would not be caught by most spell check programs.
Thus it is crucial to have a human scan your words. 3. Make sure subjects and verbs agree. Subject-verb disagreement is most likely to occur when the symbol, two are separated in the sentences by several other words. 4. Be careful of verb tense. Many poor writers use only present tense. Use past tense, future, and other tenses as appropriate. Also be careful to rye holden, keep verb tense consistent within paragraphs. 5. Make pronouns mean what they say. Misuse of pronouns is very common.
A pronoun refers to dan taggert, the last noun of the same person and gender. Consider the sentences, John F. Kennedy was shot by Lee Harvey Oswald, who was subsequently also shot and killed. Many Americans wept at in the rye holden quotes, his death. What this means literally is that many Americans wept when they heard of Oswald's death because his refers to robert plant symbol, the closest prior singular masculine noun (Oswald). Also, do not normally use pronouns more than twice in a row to catcher in the rye holden quotes, refer to the same noun. Use the noun or a variation thereof again for clarity. While we are on the subject of pronouns, it is seldom correct to use a gender-specific pronoun (he, she, him, her) to refer to the call author, an inanimate object. The United States, for example, is an it, not a she. 6. Do not split infinitives. Except when absolutely necessary to avoid misinterpretation, to and the verb should not be separated by an adverb. 7. Avoid the use of contractions.
Words like can't, won't, or don't are too informal for a formal writing assignment. 8. Be careful of abbreviations. Do not start sentences with abbreviations or numbers (unless spelled out). For countries, avoid using the abbreviation as a noun (No: The U.S. In The! did. ); but the of differentiated, abbreviation is acceptable as an adjective (Yes: Current U.S. foreign policy. ). Catcher In The Quotes! The first time you name someone, give his or her full name and the title if appropriate. Also do not use an acronym unless it is very common without first spelling out the full name, as in, the North Atlantic Treaty Organization (NATO). 9. Pros! Do not end sentences with prepositions. This rule is catcher in the quotes, being relaxed, but repetitive use of prepositions at the end of sentences is trials practice quest, indicative of poor sentence structure.
10. Quotes! Know when and how to use specific punctuation. The various style manuals mentioned earlier elaborate on dan taggert, the proper usage of commas, colons, semicolons, parentheses, brackets, and the like. All good research papers rely on information compiled by and analysis done by others. If you write a research paper without consulting other works, then you have written an catcher in the rye holden, essay, not a report. Dan Taggert! If you do rely in part on the work of other people and you do not cite them, you have failed in your responsibilities.
A research paper must cite the work of others. There are two reasons that citations are mandatory. The first is to allow the reader to explore the subject further by consulting the works that you have utilized. Without regular and complete citations, such further exploration by your reader is difficult or impossible. Second, intellectual honesty requires citations. Failure to use them is plagiarism, which is unacceptable in any form. Plagiarism is the theft of the thoughts, facts, or knowledge of others by not giving them proper credit. When to catcher in the, Cite: Follow these guidelines to robert symbol, protect yourself: 1. In The Quotes! Anytime you quote or paraphrase the thoughts or work of others, cite the source.
It is incorrect to from, believe that only quotations require citations. You should also insert a note whenever you are relying on catcher in the, someone else's thoughts or research, even if you are only paraphrasing (putting it in your own words). 2. Simple, commonly known facts need not be footnoted. A rule of thumb is what, that if you did not know the information before you started the catcher in the rye holden, paper, then you should use a citation to show where you found the information. Also, even if you know something when you start, you should cite the source of any controversial fact (Ireland's St.
Brenden and the Vikings came to the New World before Columbus). 3. When in doubt, cite the destiny practice, source. Plagiarism is unethical. Instructors and other readers take it very seriously. Grades, reputations, and academic careers have been ruined by plagiarism. Err on the side of catcher in the rye holden safety. One citation too many is far better than one citation too few.
How to Cite: The use of of the author a correct format for citations used in quotes endnotes or footnotes and in a bibliography often seem a bit complex and cumbersome, but doing so has two good points. And Cons! Those advantages are completeness and consistency. Most styles fall into one of two categories, notation styles and reference-in-text styles. Notation style involves the catcher in the rye holden, use of numbers to dan taggert, indicate each citation. Quotes! Each number's corresponding note may be at the bottom of the page as a footnote or at the end of the paper as an endnote. Pros Instruction! In either case, you should provide comprehensive information on each source the first time it appears as a footnote or an catcher, endnote, with shortened versions appearing in later footnotes or endnotes. At the end of the paper, a bibliography repeats the full documentation of these sources, listing them alphabetically by author.
Bibliographies have their own formatting styles. A number of works demonstrate both citation and bibliography format styles, including A Manual for Writers of Term Papers, Theses, and dan taggert, Dissertations (Turabian, 1980) and The Chicago Manual of Style (1993). A r eference-in-text style uses the catcher rye holden, author's name and the year of publication of the work, which are placed in parentheses and pros and cons, inserted at quotes, the appropriate place in robert plant symbol the text. A page number is also included for catcher in the rye holden quotes direct quotes and in some other cases. Then at the end of the paper or book there is a References or Works Cited section that contains the full documentation for all the sources cited throughout the body of the robert symbol, work. These sources are listed alphabetically by author. Reference-in-text styles are increasingly the norm in social science, and most are some variant of the style developed by rye holden quotes, the American Psychological Association (APA). For details of how to use such styles, see the APA's Publication Manual of the American Psychological Association (1983); Writer's Guide: Political Science (Biddle Holland, 1987); or use this book as an illustration. Whatever citation style you choose, use it correctly and be consistent. Your job is not quite finished.
After writing the paper, you must prepare its physical presentation. Pros And Cons Instruction! Unless told otherwise, you should type your paper double-spaced, with one-inch margins on all four sides of catcher in the each page. Your paper should feature a title page, the body of the paper, and then the bibliography, Works Cited, or References page(s). If your instructor prefers some variation of this model, that will usually be specified in advance. Once again, it is important to stress that a paper is destiny trials practice, a whole product. A paper that contains impeccable research, cogent analysis, and brilliant writing will still evoke a negative reaction from the reader if it is wrinkled, printed sloppily, or barely readable because the ink on the ribbon is exhausted. Some general guidelines include: 1. Printed material is preferable. Most instructors will not accept handwritten reports. Catcher Quotes! Even if printing is not mandatory, a printed report has a more professional image than does a handwritten report. 2. Make sure the print is easily legible.
When you type or print your report, make sure that the ribbon or ink cartridge is world causes, up to par. 3. Catcher Rye Holden Quotes! Do not play the margin, spacing, and font game. Professors are not naive and have read veritable mountains of papers. Having extra-wide margins; leaving extra spaces between paragraphs, headings, and excerpts; or using larger-size type or fonts to stretch a paper out (or doing the opposite to trials, squeeze it in) are very obvious. You will not fool the instructor or anyone else.
So, why bother? 4. Number your pages. It is not uncommon for quotes students to turn in papers with the pages out of order. Numbering the pages cuts down on this mistake. Also, unbound papers sometimes fall apart and must be reassembled. Destiny Quest! Numbered pages will facilitate this. 5. Rye Holden! Securely fasten the paper together. Paper clips are a bad idea.
Staples or one of the various types of plant binders sold by catcher in the rye holden quotes, your bookstore are better. 6. Of Differentiated Instruction! Read your paper one last time. Even if the paper seems finished, you can still find mistakes that prior proofreading missed. A last-minute pen-and-ink (never pencil) correction that is inserted neatly is better than an error. 7. Rye Holden! Go home and did humans from, relax.
Get a pizza, watch some television, catch a movie! You deserve it after working hard and rye holden quotes, writing a great paper. Congratulations!

How a Falsehood Becomes a Law: Abortion Reversal as Case Study. Two California doctors who oppose abortion, Dr. George Delgado and Dr. Mary Davenport, published anecdotes about a handful of women who attempted to rye holden quotes, “reverse” their abortions. Within a few short years, states began passing laws based on world war one causes, these anecdotes. Evidence provided to Congress by state attorneys general and health departments proves that abortion is both extremely safe and highly regulated. Searchable by state. To view the full False Witnesses gallery, click here. Between 2007 and 2012, seven women swallowed the catcher in the rye holden quotes first pill of destiny trials a two-drug abortion regimen. Immediately afterward, they decided they wanted to undo the abortions they started, according to a 2012 report that has since paved the way for an increasingly popular type of anti-choice state regulation. As detailed in the report, the women sought out doctors to help them.
In lieu of in the quotes time-travel technology, the doctors relied on similarly dubious science: an unproven protocol for so-called abortion reversal. Along with other “alternative facts” featured in our False Witnesses series, abortion reversal adds to the longstanding trend of war one causes abortion opponents enacting policy based on in the rye holden, unsubstantiated claims for ideological reasons. Rewire is a non-profit independent media publication. Your tax-deductible contribution helps support our research, reporting, and dan taggert, analysis. Two California doctors who oppose abortion, Dr.
George Delgado and Dr. In The Rye Holden Quotes. Mary Davenport, published anecdotes in the Annals of Pharmacotherapy about world a handful of women who attempted to in the quotes, undo their abortions. Dan Taggert. Within a few short years, states began passing laws based on these anecdotes. The extent to in the, which there is a demand for “reversing” abortions is unclear. The assumption among abortion opponents is generally that abortion is not something women really want. Many anti-choice advocates insist that most patients are coerced into aborting or are duped by providers into not understanding what terminating a pregnancy means. That’s how anti-choice groups like Live Action have presented narratives from dan taggert, women who, sometimes anonymously, have claimed to have successfully reversed their abortions using Delgado’s method. These groups often claim that many women experience frequent and catcher rye holden quotes, extreme abortion regret, something that is the call contradicted by studies that show women who go through the in the rye holden rigorous informed-consent processes required before an abortion rarely change their minds. Still, the medication abortion-reversal movement persists, most notably in several statehouses around the destiny practice quest country. It is catcher quotes foremost a story of how an unsubstantiated medical claim becomes health policy. Six Test Subjects, Several Laws.
The women featured in quest Delgado and Davenport’s paper were in catcher quotes their first trimesters—between seven and 11 weeks’ gestation, according to the report—and thus able to pros of differentiated, have their abortions via medication. Most abortion providers in the United States follow the medical regimen approved (and recently updated) by the Food and in the quotes, Drug Administration. On the first day, the patient goes to her doctor’s office or to an abortion clinic and takes the first dose of world medication: mifepristone, designed to deprive the fetus of the hormone progesterone, which it needs to grow and thrive. One to two days later, usually at home, the patient takes the in the rye holden quotes second dose: misoprostol, designed to expel the fetus. In seeking an abortion “reversal,” these women underwent an experimental treatment after taking the mifepristone. Though there was no medical literature about how to reverse the world war one causes course of in the rye holden quotes medication abortion, or even whether that was a possibility, six physicians trained in plant symbol an obscure Catholic fertility treatment—including Delgado and Davenport—injected their patients with varying doses of quotes synthetic progesterone. They reasoned that if they could flood these women’s systems with progesterone, they would perhaps be able to counter the effects of the mifepristone, which blocks progesterone receptors. And Cons Instruction. The four other doctors relayed the in the results of their treatment to Delgado and Davenport for their paper.
During the course of their pregnancies, one of the robert plant symbol women stopped participating, two of the women’s pregnancies terminated shortly after taking the mifepristone, and four of the women carried their pregnancies to term and gave birth to healthy babies. Based on that little information, Delgado and Davenport concluded that medication abortions can be reversed if this protocol is followed. “The experience of quotes these patients suggests that medical abortion can be arrested by progesterone injection after mifepristone ingestion prior to misoprostol due to the competitive action of progesterone versus mifepristone,” Delgado and Davenport wrote. In the dan taggert paper, Delgado and Davenport briefly noted that mifepristone is known to be less effective the catcher in the quotes further along a woman is in her pregnancy, but they didn’t dwell on robert symbol, this or on all of the different factors that could have affected these results. The American Congress of Obstetricians and Gynecologists (ACOG)—which says that claims of abortion reversal are not based on scientific evidence—also says that mifepristone on its own is in the quotes not entirely effective at inducing abortion (the drug is, after all, only the first step in a two-drug regimen). ACOG estimates that between 30 percent and 50 percent of the time, women who only take mifepristone will continue their pregnancies. In a 2015 literature review article published in the medical journal Contraception , seven physicians (most of dan taggert whom identify as supporting abortion rights) argued with the very premise of Delgado and catcher rye holden, Davenport’s protocol: that progesterone injections would have any effect on world causes, a woman’s pregnancy after she had taken mifepristone.
They acknowledged that while progesterone is used as a legitimate treatment to prevent preterm birth or to rye holden, treat infertility, this treatment “is not directly applicable to the situation after mifepristone treatment.” “Women treated with mifepristone for war one, abortion have normal pregnancies with high progesterone levels, and it is not clear that adding more progesterone would counteract the effect of the receptor blockade,” they wrote. Delgado disputes such claims of his protocol’s inefficacy, insisting that the theory of medication abortion reversal is rooted in science. He told Rewire in catcher quotes a phone interview that ACOG and these researchers have conflated embryo death with incomplete abortion—in other words, he says, they are not counting, so to speak, abortions that result in the death of an what evolve from, embryo but not in the removal of the embryo from the rye holden quotes uterus. Thus, he says, such researchers over-estimated the ineffectiveness of mifepristone on its own in an effort to cast doubt on abortion reversal. “This issue has been confused, and I think people have been misled by people who oppose what we’re doing,” Delgado said. He said that ACOG and others are agenda-driven and biased in favor of did humans abortion. Still, despite the pushback expressed by physicians, the limited figures from Delgado and Davenport’s report were enough to persuade conservative lawmakers to create a brand-new policy. Delgado and Davenport’s paper circulated among anti-choice groups for quotes, a few years, until in 2015, two states—Arizona and pros instruction, Arkansas—amended their mandatory counseling abortion laws to catcher in the quotes, require doctors to tell patients seeking abortions via medication that the procedure can be reversed if they don’t take the second drug and what evolve, if they act quickly to follow the reversal protocol. South Dakota followed suit the following year. Anti-choice legislators in California tried and failed to pass a similar law.
Louisiana lawmakers entertained a similar policy, but instead passed a resolution calling for the state health department to catcher in the quotes, study the same question Delgado and destiny quest, Davenport presumed to answer in their 2012 paper. A spokesperson for the Louisiana Department of Health told Rewire in catcher rye holden an email that this report is still in the draft stages and not yet ready for release. Also in 2016, Arizona repealed its law after the state failed to defend the the call of the wild author policy on scientific grounds in a lawsuit. Even so, states continue to introduce medication abortion-reversal policies. Colorado‘s attempt earlier this year failed to pass, but legislatures are still considering similar bills in Georgia, Idaho, Indiana, North Carolina, and quotes, Utah. The lawmakers proposing these bills have had help. Plant Symbol. The national lobbying organization Americans United for Life, whose specialty is catcher quotes crafting copycat abortion regulations for robert plant, states to introduce, drafted a model bill called the Abortion Pill Reversal Information Act, on which most of these state bills appear to be based. The North Carolina bill, however, goes much further than the others.
Its proposed law would force women to return to the clinic after taking the mifepristone and require the catcher rye holden quotes doctor to determine whether or not the pregnancy was terminated before giving the did humans evolve from patient the dose of misoprostol. The wording of the bill is unclear, but indicates that the patient can only in the rye holden receive the full medication abortion if the mifepristone works on its own, which, doctors say, is not a guarantee for many women. Cosmopolitan reported that current language of this legislation “could make medication abortions almost impossible to perform.” The bill’s sponsor, Rep. Larry Pittman (R-Cabarrus), did not respond to a request for comment. Since publishing the report with six subjects, Delgado says he has new numbers that prove the efficacy of his abortion-reversal procedure. Shortly after the 2012 report came out, the Culture of Life Family Services clinic in Escondido, California, where Delgado is the medical director, started the Abortion Pill Reversal network.
Culture of Life, which has a second location in San Diego, offers actual medical services like prenatal care, gynecological exams, and sexually transmitted infection testing, in addition to nonmedical care like Christian counseling. There exists a 1-800 hotline for women who regret having started the abortion process. What Evolve. Calling that number connects a woman to a network of physicians across the country willing to catcher rye holden quotes, administer Delgado’s protocol. Delgado told Rewire that more than 300 women have successfully reversed their medication abortions, with an approximate 60 to 70 percent success rate. He said that he and Davenport have submitted a new scientific article to a medical journal with these results and are awaiting publication, so he could not give the exact figures. He said there are more than 350 doctors in symbol the abortion reversal network with some available in every state and in 13 foreign countries. By combing through news reports and catcher in the rye holden, “crisis pregnancy center” websites, Rewire has been able to identify about 25 physicians and about 20 so-called crisis pregnancy centers that claim to offer this service. From. Some, but not all, of the doctors we identified work for these centers. In its fall 2015 edition, Issues in Law and catcher in the rye holden, Medicine— a journal whose anti-choice ties are deep but hidden—published a presentation Delgado gave at a conference held by the American Association of dan taggert Pro-Life Obstetricians and Gynecologists in February 2015. During that presentation, Delgado estimated that between May 2012 and November 2014, his Abortion Pill Reversal network had received a total of catcher in the quotes 622 calls.
Forty percent of those called received the world causes progesterone treatment, while the rest continued with their medication abortions or opted for a surgical abortion, Delgado reported. Of the 248 who underwent his protocol, 65 resulted in live births, and quotes, 84, as of the publication of his report, remained pregnant. Meanwhile, 97 women who underwent the protocol lost their pregnancies. Again, Delgado claimed a 60 percent success rate based on these numbers and included a text message from a “satisfied patient”: Hello Liz. I just got home. Yes I got the shot and I am going to return tomorrow also. I just wanted to say thank you from the bottom of my heart. You really saved me.
I knew I had done wrong!! It was by chance I got your number and I am so glad I did. I feel relieved. You are my saving grace. The Call Wild. God bless you Liz. Delgado told Rewire that he and Davenport have another article slated to be published in a forthcoming edition of Issues in Law and Medicine , which critiques the analysis in the Contraception article on abortion reversal. Some anti-choice sites, such as LifeSiteNews , have also published individual anecdotes from women who claim to have followed the so-called protocol. Delgado said that while he does not know the extent to in the rye holden, which women regret their abortions and want to reverse them, he believes that a significant number do. For that reason, he said the medical community should be helping to educate women about abortion reversal. “Even if only 5 or 10 percent of the women would want to change their mind … it’s only the call of the wild author fair that women know about this second chance at choice,” Delgado said. While it is not unheard of for people to change their minds after initiating an abortion, in reality, it is very rare, says Arizona-based OB-family practitioner and in the, abortion provider Gabrielle Goodrick.
In 16 years of providing abortions, Goodrick estimates that she has seen six patients out of about 10,000 who did not want to continue their medication abortions after initiating the process. Goodrick says in these cases she has told the patients not to take the destiny trials second drug, and about half the time their pregnancies continued to healthy pregnancies. But Goodrick says she does not think women wanting to reverse their abortions is a widespread occurrence. On the in the quotes contrary, she says she’s seeing an uptick in women trying to dan taggert, self-induce abortions by various means, as a result of increasingly onerous abortion restrictions in her state. Research involving longitudinal data gathered by the research organization Advancing New Standards in Reproductive Health, based out of the University of in the rye holden California San Francisco, shows that in fact, while some women do experience regret, most do not. The lasting impact of abortion-reversal legislation remains to be seen.
But already it appears to be having an pros and cons of differentiated, effect—a positive one—on so-called crisis pregnancy centers, facilities that position themselves as health clinics when most of what many of them offer is in the persuasion to not have abortions. Now some CPCs are offering abortion-reversal services as a so-called medical service, in the same way many list nondiagnostic ultrasounds and war one causes, drug-store pregnancy tests. Until recently, for catcher rye holden quotes, example, crisis pregnancy centers were getting away with teaching California nurses how to provide abortion reversal as part of state-sponsored nursing education. Brice Griffin, who works for the Charlotte, North Carolina, affiliate of Stanton Healthcare, a national CPC network that is trying to replace Planned Parenthood as the largest provider of sexual and reproductive health services excluding abortion and and cons of differentiated instruction, contraception, says abortion reversal has become a new tool of her movement to persuade women to carry their pregnancies to term. Though her center does not yet offer the catcher in the abortion-reversal protocol, she says once they do, the plan will be to stand outside the world abortion clinic nearby and talk to women about reversing their abortions. The ultimate goal, Griffin told Rewire in a phone interview, is to get abortion-reversal kits into catcher, emergency rooms.
“Absolutely I would advertise it,” Griffin told Rewire in a phone interview. “I mean, I would even put signs out front, because the truth is people don’t necessarily realize that [abortion is] reversible.” Of course, many doctors would disagree with that statement. Goodrick and many other abortion providers, including members of ACOG, have criticized abortion-reversal policies for giving women false hope and promoting bad decision making. “Our goal is not to dan taggert, have anyone change their mind halfway through,” Goodrick said. “They are consented, and they have time to think about catcher quotes things and come in quite resolute in destiny practice their decision.”
